To file for divorce in Minnesota you must file a Summons and a Petition for Dissolution of Marriage with the Clerk’s Office of the county court. Although the exact filing fee will depend on the county in which you file, Minnesota has some of the highest in the nation with the average around $400. Whether or not you are representing yourself, you must also file a Certificate of Representation.
The court will order a reasonable amount of child support to be paid by the non-custodial parent. Minnesota law has guidelines that say how much support should be paid. The court can also order either parent to pay medical insurance premiums or expenses and to pay part of child care costs. The court considers the parent's income or ability to earn income and the number of children supported.
The other party is often awarded a lien or a mortgage for a share of what the property is worth. A lien is a claim on the property. The party awarded the real estate owes the other party the amount of the lien or mortgage. The Judgment and Decree usually sets a date by which the payment must be paid. If the lien is not paid when due, the party owed the money can ask the court to order the other to pay the lien, or to change division of the property in the Judgment and Decree. In the case of a mortgage, the holder of the mortgage could foreclose.
The reasons for divorce in Minnesota include general and no-fault reasons. Proper grounds for the divorce must be given. No-fault reasons for the divorce include an irreparable breakdown of the marriage for reasons including living separately for 6 months or serious conflict between the couple. General reasons include only one reason, which is the irrevocable disrepair of the marriage with no chance of repair.
2. In divorces, there is inevitably a process of “discovery,” where each party requests information and documents from the other party. Sometimes this is informal and limited. Other times it is formal, comprehensive, and terribly time-consuming for the parties themselves (to gather the information), and for their lawyers (who must review the responses and put them together in proper legal form). Because most attorneys are sloppy and lazy with formal discovery, they request much more than is really necessary to settle a case, just to cover their butts and to avoid the work of tailoring the discovery demands to each particular case, or just to make the process more onerous for the other party.
The divorce becomes final when the court clerk "enters" the Judgment and Decree, which means the clerk writes it down on a court list of all judgments. The Judgment and Decree contains the final decisions of the court. Sometimes it is a week or more after the default hearing before the Judgment and Decree is entered. The court clerk may send a copy of the Judgment and Decree to the petitioner's attorney. This attorney serves the respondent with the final Judgment and Decree and gives a copy to the petitioner. There is no waiting period in Minnesota—the divorce is completely final when entered.
You may be surprised to know that many divorcing couples are fairly respectful of each other and work well together in divorce mediation. There are also many couples who are very emotional about the divorce and as a result, exhibit more conflicted behaviors or believe they can not successfully negotiate face to face. If one of the parties is awarded ownership of the home or other real estate, the Judgment and Decree will describe exactly how the transfer is to happen. Many times, the Judgment and Decree orders the other party to sign a Quit Claim Deed. A Quit Claim Deed transfers his or her rights in the real estate to the party who was given the property. The Quit Claim Deed and the Judgment and Decree are filed with the County Recorder or Registrar of Titles. If the property is registered (called Torrens) property, the owner's duplicate certificate of title is needed. The Quit Claim Deed and the Judgment and Decree are then "memorialized" by the Registrar of Titles and a new title issued. If the Quit Claim Deed is not signed and provided, you should check with an attorney and/or the County Recorder or Registrar of Titles to find out what to do.
This is a common fear which is rooted in the adversarial legal system. The reality is that many parents who are mediating their divorce separate before the divorce is final, some even purchase a second home. Living together after a decision has been made to divorce is extremely difficult. Separation provides many people the distance they need to more successfully manage the challenges and difficulties of divorce. During mediation you have many opportunities to be creative and solve problems in a cooperative and mutually beneficial manner.
It also possible, as part of settlement agreements to contractually limit the amount and duration of spousal maintenance, and limit or prevent altogether any future modification of maintenance, though what is known as a "Karon waiver". Benefits of such waivers involve certainty to both parties as to amount and duration of maintenance. Risks also are possible, if a party contracts to a set term and amount of maintenance, and either through illness or job loss, either cannot meet their obligation or may need an extension of their award, as most waivers require the court to give up jurisdiction to make such a change. Importantly, Karon waivers may only be agreed upon by both parties. If there is no such agreement, a court may never order such limitations and waivers of rights to future "modification" of the amount or duration of maintenance.
You are not obligated to hire an attorney in order to file for divorce; however, having one greatly improves the likelihood your rights will be protected and that your divorce is done correctly. Otherwise, you may end up spending much more on hiring an attorney after your divorce to seek post-decree modifications to clean up anything done improperly at the outset. Having a lawyer with you during this process also lessens the pressure on you during this difficult time. Further, hiring a lawyer is especially beneficial if there are allegations of abuse — spousal, child, sexual or substance abuse — because in those situations, it may be impossible for the abused spouse to negotiate effectively. A lawyer can help arrange the necessary protection for an abused spouse and the children. There are many other instances where a lawyer will be significantly helpful in a divorce, such as: asserting a non-marital claim, complex finances, divorces involving business ownership, divorces involving one spouse living in a different state, and many more instances.
If one partner is really invested in making the other person’s life worse—like not allowing her to take vacation with the kids and her family when it’s convenient, just because he wants to muck up her vacation plans—they are not good candidates for mediation. Green says, “If you feel like your ex is a narcissist or out for revenge,” mediation is not going to work.

Clients often ask whether they should move out of the marital home prior to or during the commencement of divorce proceedings. The answer is very clear: “it depends”. Generally speaking, if child custody, parenting time, or possession of the home might be an issue in the proceedings, I advise against it. Fees may be charged on an hourly basis, or by the day or half-day. In general, mediators help the parties meet, explore options, and negotiate a mutual settlement to resolve their dispute. Mediators do not determine who is right or wrong. Instead, they help the parties reach a solution on their own that works for them. Parties should seek mediators with mediation training, experience, and specific knowledge of family law. It's also important to consider the mediator's style and mediation philosophy.
The cost of mediation may be based on Florida Statutes which provide a reduced rate for couples with a combined income of less than $100,000. Both parties will file a financial affidavit in order to establish the exact fees for divorce mediation. A Florida judge may waive mediation requirements but generally will not do so. Costs associated with divorce mediation may include the mediation costs, filing fees, recording fees, and service of process fees if the mediation is court-ordered. These fees may be levied against the non-prevailing parent if the court determines that parent is able to pay.
Early Neutral Evaluation (ENE) in Family Court Cases - For parents who are getting divorced, this statewide program connects them with judges and evaluators early in the court process to give them an opportunity to settle their legal issues. Parties can choose to participate in one or both types of ENE: a Financial ENE (FENE) to settle financial disputes; and Social ENE (SENE) to settle custody and parenting time issues involving their children.
