The answer to this question varies. The “average” divorce can take anywhere from 6 weeks (or less), to a year and a half or more. How long your divorce will take depends on how well you and your spouse can cooperate, and on the complexity of the issues involved. Don’t ignore it! First, you should read the Summons and Petition completely and decide whether you agree with what it says or not. Second, you should make sure you note any hearing dates. This will give you your timeframe for responding the the Petition. If you do not go to the hearing, the case will end in a default decision and your spouse will receive whatever he or she asked for in the Petition. If you have any objections, or if you do not understand what the Summons and Petition say, contact an attorney for guidance.
The court may appoint a “guardian ad litem” if it believes one party has hurt the child or that having someone to represent what's best for the child would be helpful. A guardian ad litem advises the court about custody, parenting time and support during the case. A guardian ad litem is different from other kinds of guardians. The guardian ad litem does not have custody. A guardian ad litem makes an independent investigation about what's best for the child and writes a report for the court. The parties may be asked to pay the costs of a guardian ad litem.
The big warning I have is this: years ago, when the program started, the idea was that the evaluators would give their opinion of how they would likely decide the case in a full-blown custody evaluation, based on the facts learned in the SENE. This honest appraisal of how a months-long custody evaluation would likely turn out is what helped parties to settle their cases.
When a problem must be settled before trial and the parties cannot agree, one of the parties may request a motion hearing before the court. Motions may be used to ask the court to make the other party turn over evidence or to enforce the decisions made by the court in earlier orders. Sometimes the temporary relief order must be changed when there has been a change in the facts or an important problem was overlooked at the first hearing.
Petition for Dissolution of Marriage and Decree of Dissolution of Marriage. These are the essential documents needed to start and finalize a dissolution of marriage according to Minnesota law. There are anywhere from ten to twenty other documents that may be required throughout the filing process. A few other documents that are typically filed during the process are: Summons, Form 11, Confidential Information Form, Marital Termination Agreement, Financial Affidavit, and Affidavit of Non-Military Status.
Such arguments are made both in support of temporary as well as permanent relief. Such arguments do not always carry the day, but it is often a consideration that influences judges, even if they deny it. If custody is in issue or you really want to keep the house, try to stay put until the temporary relief hearing, which is your first opportunity to legally compel the other party to move out.
The Summons is a separate legal paper telling the respondent to answer the Petition within 30 days. If the respondent does not, he or she is in default and the divorce is uncontested. This means the petitioner (the spouse who wanted the divorce) may be granted the divorce and other relief requested. The Summons also forbids both parties from selling or getting rid of any property or harassing one another. It requires each party to maintain any insurance for the family. If one spouse spends money belonging to both parties after receiving the Summons, he or she will have to explain to the court why the money was spent.
Like attorneys, most mediators charge by the hour. The average total cost of divorce mediation (with me) is approximately $2,000. In addition to the mediator’s fees you will need to pay a filing fee to your county of approximately $400 and if you choose to hire a professional for legal drafting, you should also expect an additional $1,250-1,500. On average, my clients incur a total combined cost of approximately $4,000.
Many individuals mistakenly believe that they’ve abandoned their equity in the family home by moving out. While the court may award the family home to the spouse living in it at the time the divorce is heard, the spouse that moved out will typically be awarded other property or a cash settlement equal to his or her equity in the home. The bottom line here is that you don’t give up your equity in the marital home by moving out.
File a notarized “Separation Agreement” signed by both parties. This is a written contract between spouses that addresses all issues related to:Property division (How are property and debts to be divided? Will one of you keep the house or will you sell the house? How will your retirement accounts be divided? What happens with credit card and student loan debts?)
Then the respondent's attorney calls the respondent’s witnesses. After the respondent's attorney rests, the petitioner's attorney may call witnesses to respond to the testimony given for the respondent. The respondent's attorney may do the same. When all of the testimony is completed, the attorneys argue the case, saying why the judge should rule in his or her client’s favor. Then the judge ends the trial. The judge may announce a decision at the end of the trial. He or she may take time to think about the case and make the decision later. By law, the judge has 90 days to decide the case. Usually the judge sends copies of the decision to the attorneys. The divorce becomes final when the court clerk enters the Judgment and Decree for the court. The clerk tells the attorneys when the Judgment and Decree has been entered. The Judgment and Decree is the final decision in the case.
In order to make informed decisions as to division of marital property, and appropriate amounts of child support and spousal maintenance, it is necessary for each party to be fully informed of identity of each parties' income and assets. This information is typically exchanged through a process known as discovery. This is a process in which the lawyers may utilize numerous techniques for obtaining the financial information necessary to fairly identify and value all income and assets. The lawyers may informally by letter request the information they feel is necessary to identify all marital income and assets, or, in some cases may feel the need to serve "Interrogatories" and "Requests for Production of Documents” which are formal questions and requests for financial information and documents, such as tax returns, bank statements, financial statements and other information, which must be answered and sworn to under oath, within thirty days. In today's practice, some court's control what discovery they will allow, and may not immediately allow for the service of formal discovery, preferring the parties first use informal discovery. The attorneys may also notice the depositions of the parties themselves, or other people who may have relevant information, such as bankers and business associates. At a deposition the witness is sworn under oath, and the attorneys ask questions of the witnesses, which testimony is preserved in writing by a court reporter. The attorneys may also employ experts, such as "vocational evaluators," in the event it is alleged that a spouse who has not been working or who has only been working part time, is able to earn income to contribute to their support. They may also employ accountants or other business valuation experts to appraise family-owned or closely-held businesses. They may also employ other experts to appraise other assets such as real property and personal property, such as furnishings, jewelry and artwork.
Mediation sessions are typically 2 – 3 hours long and scheduled approximately 2 weeks apart. Most of my clients reach a complete settlement in between 6 – 8 hours of mediation occurring over a 6 – 8 week period of time. Depending on the county in which you live and the time of year, processing of your legal documents can take the court another 1 – 8 weeks.
In the framing stage, the mediator helps each spouse outline that person’s reasons for wanting certain outcomes in the settlement. These reasons consist of individual concerns, priorities, goals, and values. They are often referred to by mediators as “needs and interests.” Here, we use the broader term “interests.” Identifying interests helps to frame the core goal of the mediation: finding a resolution of the issues that successfully addresses each spouse’s most important interests. In most divorces, many issues need to be examined in light of each spouse’s interest. These include property and debt division, child custody, child support, and alimony.
Most mediators will emphasize the problem-solving aspect of negotiation at this stage. The problem to be solved is finding settlement options that address each spouse’s most important interests as fully as possible. With this focus, you’ll be able to negotiate by trading off acceptable options instead of getting locked into zero-sum bargaining, where one spouse’s gain is the other spouse’s loss.

The court forms for marriage dissolution (divorce) only give you 1 option -- one spouse gets 100% of the house, cabin, or other real estate, and the other spouse gets a lien.
