Like attorneys, most mediators charge by the hour. The average total cost of divorce mediation (with me) is approximately $2,000. In addition to the mediator’s fees you will need to pay a filing fee to your county of approximately $400 and if you choose to hire a professional for legal drafting, you should also expect an additional $1,250-1,500. On average, my clients incur a total combined cost of approximately $4,000.
Mediation sessions are typically 2 – 3 hours long and scheduled approximately 2 weeks apart. Most of my clients reach a complete settlement in between 6 – 8 hours of mediation occurring over a 6 – 8 week period of time. Depending on the county in which you live and the time of year, processing of your legal documents can take the court another 1 – 8 weeks.
Very few things in any family law issue are black and white. If the court determines that there is probable cause that one of the parties, or a child of a party, has been physically or sexually abused by the other party, the court shall not require or refer the parties to mediation or any other process that requires parties to meet and confer without counsel, if any, present. In Minnesota, alimony or spousal maintenance is available as temporary, short-term or long-term. Temporary alimony includes payments made during the course of the divorce proceedings, while short-term involves a limited period following the divorce. Long-term spousal maintenance is essentially permanent. In most cases, alimony is short-term and allows the dependent spouse to obtain skills to sustain themselves. The court will consider the following when awarding alimony:
Going through a divorce can be one of the toughest times in your life. In mediation, the couple, with the help of the mediator, works out agreements on the above issues. Sometimes agreements come easy, sometimes they take time and a lot of work. When agreements are hard to reach, that is when the mediator intervenes. It is the mediators job to keep the lines of communication open, brainstorm ideas, reality test the couple, teach empathy and assist the couple in their decision making process. Mediators help keep the couple focused on the issues at hand, trying not to get them off track. When divorcing couples get off track and away from the above issues during mediation, arguing, name-calling and bad prior memories are brought up.
The main advantage of mediation is that it keeps you and your spouse in control of your own divorce. That can make all the difference in your recovering from your divorce and moving on with your life. Mediation allows the two of you to get through your divorce with less conflict than you would experience in an adversarial divorce. Because mediation is all about working with shared knowledge, mediation also often allows you and your spouse to work together to lower your tax bill . . . and that can often translate to more money for you.
While most parties find mediation to be an excellent alternative to the traditional litigation approach to divorce, it may not work for everyone. It is not as effective when one party is unable to express opinions fully and without fear, or when the parties refuse to compromise or mediate in good faith. Additionally, some legal commentators are concerned that mediators may be unable to handle the complex financial arrangements involved in some divorce agreements.
Your agreement can include all parts of a divorce or focus on only financial or child-based issues. Again, this is up to you. The mediation process is confidential. Aside from agreements reached in writing, everything said in mediation is confidential. Like a psychologist’s office, your mediator cannot be called as a witness to anything said in mediation. This confidentiality lets couples discuss matters more freely than before a judge and lets them move past and resolve issues.
A mediator is a neutral professional specially trained to help you and your spouse reach agreement about all the important legal issues relating to your divorce. A mediator is not a decision maker. With collaborative law, you and your spouse each hire specially-trained collaborative attorneys who advise and assist you in resolving your divorce-related issues and reaching a settlement agreement. You will meet separately with your own attorney and then the four of you meet together on a regular basis, in "four-way" meetings. A collaborative divorce usually involves other professionals, such as child custody specialists or neutral accountants, who are committed to helping you and your spouse settle your case without litigation. Ordinarily, both spouses and their attorneys sign a "no court" agreement that requires the attorneys to withdraw from the case if a settlement is not reached and the case goes to court.
When discussing issues concerning custody parental access, think about where your kids will spend most of their time: where they go to school, where they take dance and karate and other extra-curricular activities. Think about whether they have any special needs and how you’ll care for them, how you’ll cover any private school or college costs, and where they’ll spend birthdays, holidays, and special occasions.
1. If custody or parenting time is in issue, don’t move out without first getting an enforceable written stipulation addressing custody and parenting time after the move-out. The key is to have in place at least an interim parenting time schedule which affords you at least as much parenting time as you hope to obtain through the court. Otherwise, the longer you acquiesce to a pattern of parenting time that is less than you desire, the more of an argument the other party will make of it against you. In some cases, the court may order spousal maintenance for a limited time while the spouse returns to school or trains for employment. Permanent spousal maintenance may be awarded if the court finds that one of you will not be able to adequately support yourself. The court will consider age, health, education, work experience, skills and other factors.

If your spouse tries to conceal assets, it will not benefit them. Courts do not look favorably on dishonesty. Further, divorce attorneys can use a variety of tactics to uncover assets and income, such as formal or informal discovery requests, subpoenas, contempt motions, etc. Finally, even if you find out that your spouse concealed property after the divorce is final, the Court has the discretion to reopen the proceeding and distribute or redistribute property accordingly.
Many metropolitan counties, as well as more and more outstate counties, have developed several innovative tools aimed at facilitating quick resolution of traditionally volatile areas - custody/parenting time and economic disputes. If the court is advised a custody/parenting time is present, the judicial officer will suggest that the parties participate in an "Early Neutral Custody Evaluation," referred to as a Social Early Neutral Evaluation "SENE" or in some counties and in others a Custody and Parenting Time Early Neutral Evaluation "CPENE." In this process the parties and counsel will be quickly scheduled to meet with two experts on child custody matters, one male and one female. Many counties have rosters listing the names of people certified to act as an Early Neutral Custody Evaluator. The parties and counsel will meet for three hours with the evaluators, with each party then afforded the opportunity to explain their role in raising the children, and what type of a parenting schedule they believe to be in their children's best interests. The two evaluators will then briefly adjourn, and then return to advise the parties what recommendation would result from a full custody evaluation. Many parties are able to reach a settlement of most parenting time issues after hearing this informal report.
Mediation preparation is often limited, as there is no formal discovery. Frequently, mediation begins with a "general caucus" where the parties and the mediator meet in the same room. The mediator establishes the ground rules in an "agreement to mediate." In court-mandated mediation, the court order will often contain or refer to the "rules of mediation." One of the most important mediation rules is the requirement for confidentiality.
Judges frequently say that if both people are unhappy with the judgment, it’s a good one. In the context of divorce this philosophy is even more appropriate as there are no winners when a marriage ends. Whether in court or in the mediation room, 100% mutual satisfaction with decisions and agreements is rare. As a mediator I believe that my clients are best qualified to determine what is “fair” regarding the restructuring of their lives. I encourage my clients not to define success by happiness or victory; but rather by the effectiveness of the process.

Some people think it will be easier and safer to have an attorney fight for their legal rights. Unfortunately, maximizing your legal rights often comes at someone else’s expense (for example your spouse or your children). This is referred to as a “win-lose” situation. All too often the transactional costs (both financial and emotional) of a “win” far exceed the value of the victory, especially for children. Although a good lawyer can be helpful, the adversarial legal process is expensive and often seeks to solve problems through opposing positions, and win-lose thinking. In my opinion, this adversarial approach is not only expensive and emotionally challenging; it is also detrimental to the long-term well-being of the people involved, especially the children. It may surprise you to know that most of my clients are unrepresented and successfully reach a complete mediated divorce settlement without retaining an attorney. My standard advice to people considering which divorce process to choose is to start with mediation and see how it goes. You may consult with or retain an attorney at any time and you never give up your right to go to court if mediation is partially or completely unsuccessful. With success rates as high as 80–90% and average savings of 20-50%, it seems the better question to ask may actually be, why wouldn’t you try mediation first?
In almost all cases, you will be required to attempt some form of alternative dispute resolution. This will typically take the form of "mediation" which is a process in which a neutral third party, typically an attorney trained in mediation, will attempt to assist the parties in reaching their own compromise settlement of some or all issues between the parties. The mediator does not make decisions, but rather facilitates a discussion between the parties (sometimes alone and sometimes with the assistance of counsel) aimed at reaching settlement of your issues. The mediation process is confidential, and if you are not successful in reaching a mediated settlement, the judicial officer will never learn what positions either party took in mediation. As part of the mediation process, the mediator will request both parties provide an accurate summary of income, assets and liabilities. It is recognized that sometimes, one party controls some or all of this information, and skilled mediators attempt to assure that there is a full and fair disclosure of financial information, and a full and fair discussion of the issues.
It is possible to complete your divorce without representation by a Minnesota divorce attorney. However, it is not recommended as this process is emotional and often more difficult than originally expected. It should come as no surprise that it is difficult for parties to a divorce or other family law dispute to reach agreements on important issues on their own. However, oftentimes, disputes related to divorce and other family law matters can be resolved with the assistance of a neutral third party through mediation. Remember that even though your children may be small today, as they grow up your roles as parents will change. You may have to consult with each other on important life decisions such as medical needs, or see each other at milestones like graduations, weddings, and the birth of your grandchildren. Minnesota is an equitable division state. In an equitable division state, each spouse owns the income he or she earns during the marriage, and also has the right to manage any property that's in his or her name alone. But at divorce, whose name is on what property isn't the only deciding factor. Instead, the judge will divide marital property in a way that the judge considers fair, but won't necessarily be exactly equal.
In some cases, there will be a temporary relief hearing. This hearing can take place after the Summons and Petition have been served. At the hearing the court makes an order that sets the rules for the parties until the divorce is final. A temporary relief hearing is especially important if children are involved and there is disagreement over custody, or if child support needs to be decided right away.
Judges, evaluators, and guardians will often pontificate about the virtue of compromise and settlement, as if this were the ultimate objective of any reasonable person, rather than as a means to an end. They speak as if both parties are equally to blame for a failure to settle, when in fact such failure is often the result of only one of the parties, who is being excessively greedy, obnoxious, stubborn, or selfish.
Spousal maintenance is money paid to support an ex-spouse. Either spouse can ask for spousal maintenance, but the court will not award spousal maintenance unless there is a need for it. Spousal maintenance may be granted for several reasons. These include disability or illness or not having worked outside the home for a number of years. If there is a large difference between your income and that of your spouse, you may be in need of spousal maintenance.
