Like all states, Minnesota courts begin with a presumption that it's best for a child to have frequent and continuing contact with both parents after a divorce. If possible, judges want to support joint custody arrangements. However, the exact nature of the time-share will be determined by the children's best interests. A business which is the sole source of the couple’s income could end up shut down if the couple is unable to discuss the issues related to the business. This could lead to both parties suffering financially. A divorcing couple with a business can enter divorce mediation and may be able to come up with a compromise which could potentially save the business. Even if every little detail is not agreed upon, the mediator will attempt to get the couple to work together for the good of the business.
Mediation also allows couples to avoid the risks of trial, protects confidentiality, and decreases stressful conflict. Mediation may also protect the children of a marriage from the pain of parental conflict. Because the parties work to create their own agreements, couples who mediate their divorce settlement often find greater satisfaction than those who go to trial. Moreover, the couples learn skills to help them resolve future conflicts.
A mediator’s job is to get you to reach an agreement. Their sense of professional fulfillment is satisfied when an agreement is reached. Unfortunately, all too often, this can result in a person agreeing to things that are contrary to his or her interests, contrary to what the Court would order, and — in the worst case — contrary to the best interests of the children. Therefore, it is critically important to either have an attorney with you at the mediation session, or at least have one on retainer at the time, to consult before you agree to anything.
(1) it contains a provision stating that it is binding and a provision stating substantially that the parties were advised in writing that (a) the mediator has no duty to protect their interests or provide them with information about their legal rights; (b) signing a mediated settlement agreement may adversely affect their legal rights; and (c) they should consult an attorney before signing a mediated settlement agreement if they are uncertain of their rights; or
While it may be true that the two people are too emotional to sit down together alone, in mediation they work with their mediator, a trained professional and neutral third party, who has experience and training to help them focus on the issues at hand and to work together to resolve them. The mediator has many tools available to assist when emotions run high, such as caucusing by meeting with the parties in separate rooms or using an online platform until emotions have a chance to settle down. The mediator is skilled at helping the people to focus on the issues at hand and the future rather than the things that happened in the past that brought them to divorce in the first place.
Seeing headlines like these, who doesn't think that hiring a $1,000-an-hour divorce attorney is the best way to get what you deserve? But in reality, divorce isn't a winner-take-all sport. In community property states (like California) courts have to split marital property down the middle. In states that don't have community property laws (like New York) they split assets equitably.
Case in point: I had a client once who — contrary to my advice — chose to engage in settlement negotiations for several months prior to commencement and filing of the divorce, rather than filing first and then working on settlement. The pre-filing settlement negotiations did not bear fruit, and because of the delay, the valuation date did not occur until much later than it otherwise would have, with the result that a $180,000 dividend payment received by my client was treated as martial property, when it otherwise would not have been.
Almost every state requires mediation of child custody disputes, and many states' court systems provide services such as early conflict intervention, conciliator services, community dispute resolution centers, education seminars for divorcing couples, mediation, and settlement conferences. Today, mediation, either voluntary or court mandated, is the predominant form of dispute resolution for divorcing couples.
Very few things in any family law issue are black and white. Like legal custody, physical custody can be “sole”  or “joint”. “Joint physical custody” means that "the routine daily care and control and the residence of the child is structured between the parties."  Unlike joint legal custody, joint physical custody is the exception rather than the norm, and is usually only granted if both parties agree to it.
If the court determines that there is probable cause that one of the parties, or a child of a party, has been physically or sexually abused by the other party, the court shall not require or refer the parties to mediation or any other process that requires parties to meet and confer without counsel, if any, present. (Minnesota Statutes - Chapters: 518.619)
Decisions about spousal maintenance are often emotional and challenging. Unfortunately, MN law does not specify how to calculate a spousal maintenance obligation. Unlike child support, MN divorce laws are discretionary when it comes to spousal maintenance (alimony) stating only that many factors should be considered when determining the need for spousal maintenance as well as the amount and duration of the support. Relevant factors often include: the length of marriage, each spouse’s financially ability to be self-supporting, education and employment history, age, and the marital standard of living. Mediation encourages the use of reasonable budgets and information sharing rather than the traditional adversarial legal approach which often relies on exaggerated budgets and win-lose negotiation tactics. The creation of reasonable budgets allows you and your spouse to understand your individual financial needs as well as the financial realities of your situation. This mutual understanding is vital to the successful discussion and resolution of the spousal maintenance issue. I also utilize a specialized computer program which provides useful information about tax impacts and projected cash flow for each spouse before and after the exchange of financial support.
If the parties are hostile or overly emotional, the mediator will separate the parties and shuttle back and forth between them in "private caucuses." A private caucus is a conference between the mediator and one party, without the other party being present. The mediator passes offers and demands between the parties. Conversations between a party and the mediator during private caucus are confidential unless a party authorizes the mediator to disclose information to the other side.
In most cases, divorce is a difficult and painful process, both emotionally and financially. The traditional practice of hiring a lawyer and litigating in court to end a marriage is not only expensive, but can lengthen the process, increase contention, and cause additional and unnecessary stress on you, your spouse, and your children. Most Minnesota judges encourage couples go through divorce mediation where you are making the decisions about your future rather than having a judge make them for you. Avoiding litigation is much more economical for both members of a divorcing couple, yet many people don’t realize the importance and power of divorce mediation in today’s climate.
