I treat all parties in negotiations with respect. My goal is not to create winners and losers but to use my creativity, my empathy, and my knowledge of the law to create win-win solutions to the practical problems posed by divorce in a cost-effective way. This approach to reaching divorce agreements avoids the high costs, delays, and interpersonal conflict and stress that are inevitable in litigation through family law courts. As a Springfield divorce attorney mediator, I prepare the legal papers and Massachusetts divorce forms reflecting your decisions so that a judge can approve the separation agreement and issue the divorce decree.

1. Never let your spouse suck you into a fight — even a verbal one. Once it starts getting heated, just withdraw from your spouse’s presence. While this won’t protect you against a spouse who is willing to make up a false abuse allegation out of whole cloth, it will protect you from a spouse who is trying to set you up to do something which will allow him or her to claim s/he was physically harmed or put in fear of imminent bodily harm.
I have a great deal of experience with court matters, but I am now concentrating more of my time on Wills and Probate. I have been an arbitrator of Minnesota No Fault Auto Accident Claims. I graduated from Hopkins (MN) High School in 1967; St. Olaf College, Northfield MN in 1971 (BA History and Asian Studies) and William Mitchell College of Law (now Mitchell Hamline Law School) in 1975 (JD), working days and attending classes at night through a four year program. I am married and have two adult children.
If you have been ordered to pay child support and your situation has changed so that you cannot pay the amount of support ordered, it is important to contact the county child support officer right away.  You can bring a motion to ask the court to lower your child support. If you do not bring a motion, there is little chance the court will forgive back support, even if you were unable to pay.  For more information about child support, see our booklet Child Support Basics.

If your spouse files an Answer that disputes details in the Petition for Dissolution of Marriage, then the judge will order you and your spouse to trial. There may be a number of hearings and legal proceedings before a trial occurs, so you will probably need an attorney to guide you through the process.  Before the trial, you and your spouse’s attorney may engage in evidence requests, witness interviews and negotiations.  This may be a lengthy and complex process that could cost you a great deal personally and financially.
It can be difficult for a client to know whether his or her lawyer is performing well or not. Sometimes even the best of lawyers does not achieve the desired result, and it may be due to a difficult set of facts, a bad judge and/or custody evaluator or guardian ad litem, or unrealistic expectations. There are some clear indications of bad lawyering, however, which are objectively obvious:

Without taking sides, a divorce mediator works with you and your partner to negotiate a settlement that is in the best interest of you and your family. Typically, a divorce mediator helps you better understand and communicate your individual and common interests so that you can explore reasonable options, make good decisions and reach solid agreements that benefit your family.
As a family law attorney, my primary focus is to support clients through the legal process so they may transition into the next chapter of their lives. Prior to representing clients, I worked as judicial law clerk in Hennepin County Family Court. Working side-by-side with judges, I gained an immense understanding of family court procedure, and how judges decide cases. I translate that experience to my practice every day, assisting clients in making the best decisions for their families. I have experience representing clients in all aspects of family law cases, including divorce proceeding, child custody and support matters,...

The number of times you go to court and see a Judge or Referee depends on local court procedures and whether you and your spouse can agree on issues regarding your children, property and other matters. If you do NOT agree, the case usually takes longer to finish. It is a good idea to get legal advice before finalizing an agreement with your spouse.
