Many people think that when a couple wants to live apart they have to get a "legal separation." This is not true. Often couples live apart for awhile before they decide to get a divorce. This is not "illegal." Legal separations are for people who do not want a divorce (usually for religious reasons). They still need a legal paper to settle custody, support, and property questions. The court makes the same kinds of decisions that it makes in a divorce. However, the couple remains married, and the division of property is not final.
While there are certainly divorcing spouses who can barely stand to be in the same room with one another, a large number of those going through a divorce will have a better outcome if the case is resolved through compromise and agreement rather than a long, drawn-out litigation. Mediation allows this to happen through the facilitation of resolutions which both parties are satisfied with. In fact, there are numerous advantages of mediation over court litigation when resolving disputes among divorcing couples.
Typically the SENE will involve both parties, both attorneys, and two court-appointed custody evaluators. Usually three hours is blocked for a session. During the session, each party (and his or her attorney) is given the opportunity to explain what they would like for a custody and parenting time arrangement, and why. Questions from the evaluators are asked and answered. Then there is a break while the evaluators confer. Then the meeting reconvenes and recommendations are given and explained, whereupon the parties discuss settlement.
Through a series of joint sessions we work through the three main components of a legal divorce settlement (property division, financial support and parenting plan). Generally speaking we follow these steps: 1) make an action plan and prioritize issues to be addressed; 2) determine what information needs to be gathered and shared; 3) assess if additional professional assistance from appraisers, accountants, therapists, attorneys, etc. is needed; 4) share and document your property (assets and liabilities); 5) make decisions about dividing your property; 6) create budgets for separate living; 7) determine financial support needs (child support and/or spousal maintenance/alimony); and 8) develop a detailed and workable parenting plan. In all cases, your personal and private information is treated confidentially with the same care and concern as in the legal process. The final product of mediation is a Memorandum of Agreement which is a comprehensive document detailing your agreements and which serves as the basis for your legal documents which are filed with the court.
When you have a choice, it is cheaper to cooperate with informal and limited discovery. In cases where the other party is not cooperative or not trustworthy, more formal discovery may be a necessity. Some of the formal discovery demands you receive will be objectionable. In most cases, however, it is much cheaper for you to just get the information and documents, than to pay your lawyer to argue with the other side about it. Also, don’t trickle it in piecemeal to your attorney if at all possible. Get it all together into one package, as complete and as organized as possible.
5. Use an attorney who specializes exclusively in family law, so that you’re not paying so much for the attorney to “learn”. No lawyer has perfect and complete knowledge, but a specialist is not going to have to do nearly as much legal research as a more general practitioner. (Not to mention, a specialist will be more qualified to represent you in the best way possible, because of his experience).

The court can also consider a change if the parent with custody has denied or interfered with the parenting time of the other parent. However, parenting time problems alone are usually not enough to change custody. Denying or interfering with a parenting time schedule is a factor that a court may consider in deciding to change custody. A judge can also change custody based on the “best interests of the child,” if both parents agreed to use that standard in a writing approved by the court.
If you or your partner are really committed to their narrative—that one person is absolutely the bad guy, for example—mediation might not work. Green says, “There are some people who are quite intensely invested in feeling like the victim: ‘I’m right and the other person is wrong, and there is no universe in which the other person’s actions are acceptable.’”

States regulate the manner in which marriages may be dissolved (i.e. divorce), just as they regulate the marriage process itself. These regulations often include residency requirements, waiting periods, acceptable grounds for divorce, and defenses to divorce filings. Like many family laws, the legal requirements for divorce have changed drastically over the course of history to reflect the times. For instance, a spouse who wanted a divorce had to first prove the other party's fault (such as adultery or desertion) before the advent of "no-fault" divorce.
The date on which earnings (including retirement contributions and other income) becomes separate property again, is the so-called “valuation date.”  The valuation date is the date of the initially scheduled prehearing settlement conference, unless the parties agree to a different date, or the court finds that a different date is fair and equitable.  In my experience, the Court seldom exercises its discretion to use a different date. One situation warranting a different date is where the parties have been separated for years prior to commencement of the divorce, and have been living separately, with separate accounts, insurance, bills, etc., during the separation period.
3) Contact the New York State Unified Court System's Collaborative Family Law Center. The Center offers free divorce mediation to qualifying couples living in New York City. If you and your spouse are eligible, you may get up to four, 90-minute sessions with program mediators (or six sessions, if you have children). Both spouses must agree to participate. Note: Referrals to divorce mediation will not be made in cases involving domestic violence or child abuse or where one spouse cannot locate the other.
Some find it helpful to make a list of marital events, in the order they occurred, as well as a list of the current disputes and another list of the outcomes you would like to see. Whether you put it on paper or not, have a list in your head of which issues are most important to you and which are the least important. Being prepared and on time is key to the success of the divorce mediation. You must also be prepared to talk to your spouse. If you have had trouble communicating in the past, your mediator will be there to facilitate communication. While it is important that you set goals regarding what it will take to resolve the case or the individual disputes, it is equally important you remain flexible. You may be surprised at some of the things you find out during mediation which change your perception of the entire issue.
Resolutions emerge from the mediation that are created and accepted by BOTH parties. The resolution will reflect each party's individual values and unique needs. Our experience has shown that settlements created with full participation of the parties, in face-to-face negotiations, are more likely to satisfy the needs of all parties and be honored in the future because they have crafted it themselves.
Each divorce mediator will have his or her own approach, however, some of the basics will likely remain the same. You will probably speak to the mediator on the phone, providing information about your marriage your family and the issues at hand. Some mediators will ask you for a great deal of information, while others may prefer to stick with the basics until meeting both parties. During the first meeting, the mediator will explain how the divorce mediation process will proceed. All parties may meet in the same room at all times, or the mediator may meet with each party separately at least one time.
Petition for Dissolution of Marriage and Decree of Dissolution of Marriage. These are the essential documents needed to start and finalize a dissolution of marriage according to Minnesota law. There are anywhere from ten to twenty other documents that may be required throughout the filing process. A few other documents that are typically filed during the process are: Summons, Form 11, Confidential Information Form, Marital Termination Agreement, Financial Affidavit, and Affidavit of Non-Military Status.
It can be difficult for a client to know whether his or her lawyer is performing well or not. Sometimes even the best of lawyers does not achieve the desired result, and it may be due to a difficult set of facts, a bad judge and/or custody evaluator or guardian ad litem, or unrealistic expectations. During a divorce, either party can petition the court to pay alimony or “spousal maintenance” to the other. Minnesota laws provide for this type of assistance so the lower earning spouses can maintain the same reasonable standard of living as before. Generally speaking, a court will be more inclined to order a longer period of alimony when the marriage was longer in duration.

If one of the parties is awarded ownership of the home or other real estate, the Judgment and Decree will describe exactly how the transfer is to happen. Many times, the Judgment and Decree orders the other party to sign a Quit Claim Deed. A Quit Claim Deed transfers his or her rights in the real estate to the party who was given the property. The Quit Claim Deed and the Judgment and Decree are filed with the County Recorder or Registrar of Titles. If the property is registered (called Torrens) property, the owner's duplicate certificate of title is needed. The Quit Claim Deed and the Judgment and Decree are then "memorialized" by the Registrar of Titles and a new title issued. If the Quit Claim Deed is not signed and provided, you should check with an attorney and/or the County Recorder or Registrar of Titles to find out what to do.

Then there are the parties who fall into the trap of thinking the best way to divide up assets and liabilities is by splitting each item down the middle. That can lead to thousands of dollars in additional fees that wouldn’t have been necessary if they had waited for an expert mediator skilled in the finances of divorce to offer alternative more efficient options.
To sum up, these misconceptions about divorce mediation really highlight some of the many advantages of mediating your divorce. Because the format is highly adaptable and collaborative, the parties will be supported and assisted in working cooperatively to resolve their issues. Through the process, they will make agreements that they choose to live by and will be best prepared to go forward in a productive and positive manner. Best of all, they will have avoided the expense and stress of a long, protracted court battle. In the end, almost every divorce case is suitable for mediation despite these common misconceptions.
Mediation is a forum in which a neutral mediator facilitates communication between parties to promote reconciliation, understanding, and settlement. Mediation is particularly suited to divorces and other family law proceedings because there is likely to be a continuing relationship between the parties, especially if minor children are involved. Many divorcing couples find mediation allows them to avoid the high financial and emotional costs of a litigated divorce. Because settlement is generally quicker, costs are reduced.
Like attorneys, most mediators charge by the hour. The average total cost of divorce mediation (with me) is approximately $2,000. In addition to the mediator’s fees you will need to pay a filing fee to your county of approximately $400 and if you choose to hire a professional for legal drafting, you should also expect an additional $1,250-1,500. On average, my clients incur a total combined cost of approximately $4,000.
Thereafter, if either party is still dissatisfied with the result, they may "appeal" the lower court ruling to the Minnesota Court of Appeals. Such appeals are of right, and take place before a three judge panel, after extensive briefing and oral argument to the Court of Appeals. However, once the appeal is filed, the Court of Appeals will automatically put the appeal on hold, and requires it's own attempt at alternative dispute resolution known as appellate mediation. If mediation is not successful, the entire appeal process may take upwards of a year after the trial court's final decision. The Court of Appeals may affirm all decisions outright, reverse all decisions outright, or may affirm some parts of the decree while reversing others. If a party thereafter is dissatisfied with a ruling of the Court of Appeals, they may seek discretionary review by the Minnesota Supreme Court. The Supreme Court however, denies review of most cases, and only chooses to hear a few family law cases each year. Those cases selected for review typically involve novel factual or legal issues.
The first opportunity for the Court to decide custody is normally at the temporary relief hearing. In Hennepin County, this can easily be four months or more from the date of filing. In other counties, it can be much speedier, as in Dakota or Scott County, where a temporary relief hearing date is normally available within about 3 weeks. Once the motions for temporary relief are heard, the Court has 90 days to rule, although they normally get temporary orders out within two to four weeks.
In most cases, divorce is a difficult and painful process, both emotionally and financially. The traditional practice of hiring a lawyer and litigating in court to end a marriage is not only expensive, but can lengthen the process, increase contention, and cause additional and unnecessary stress on you, your spouse, and your children. Because of this, more and more couples are looking to mediation to walk them through the intricacies of divorce and help navigate parenting agreements. While divorce is rarely an easy event, the goal of mediation is to encourage and support you in developing the best solutions for your individual situation, in a collaborative way and on your time line, which ultimately lessens the negative impact of divorce on you and your family.
In some cases, the court may order spousal maintenance for a limited time while the spouse returns to school or trains for employment. Permanent spousal maintenance may be awarded if the court finds that one of you will not be able to adequately support yourself. The court will consider age, health, education, work experience, skills and other factors.
