When a problem must be settled before trial and the parties cannot agree, one of the parties may request a motion hearing before the court. Motions may be used to ask the court to make the other party turn over evidence or to enforce the decisions made by the court in earlier orders. Sometimes the temporary relief order must be changed when there has been a change in the facts or an important problem was overlooked at the first hearing.
Mediation offers a quite different approach to resolving conflicts between the parties. A neutral third party-the mediator- assists the parties in sorting out their affairs and comes to a mutual agreement in a confidential private format. Mediation is a solid option even for those that are having trouble with communication. It is a cost-effective process and it avoids the legal war of going to court.
Seeing headlines like these, who doesn't think that hiring a $1,000-an-hour divorce attorney is the best way to get what you deserve? But in reality, divorce isn't a winner-take-all sport. In community property states (like California) courts have to split marital property down the middle. In states that don't have community property laws (like New York) they split assets equitably.
Most children of divorce exhibit signs of emotional, psychological, behavioral, and social distress. Many have significant adjustment problems and show lower academic achievement when compared with children from intact families. According to one study, 37 percent of children from divorced homes were psychologically troubled and manifested moderate to severe clinical depression, even five years after a divorce. And children deprived of frequent access to their fathers tend to show diminished self-esteem, lasting many years after the divorce.
Typically the SENE will involve both parties, both attorneys, and two court-appointed custody evaluators. Usually three hours is blocked for a session. During the session, each party (and his or her attorney) is given the opportunity to explain what they would like for a custody and parenting time arrangement, and why. Questions from the evaluators are asked and answered. Then there is a break while the evaluators confer. Then the meeting reconvenes and recommendations are given and explained, whereupon the parties discuss settlement.
There is one advantage to being the petitioner. If the parties reside in different counties, the petitioner determines venue (location) by filing for divorce in the county of choice. Venue can be critical because judicial views on custody and alimony vary from county to county. The respondent can request a change in venue, but will need to show a good reason for the change.
3) Contact the New York State Unified Court System's Collaborative Family Law Center. The Center offers free divorce mediation to qualifying couples living in New York City. If you and your spouse are eligible, you may get up to four, 90-minute sessions with program mediators (or six sessions, if you have children). Both spouses must agree to participate. Note: Referrals to divorce mediation will not be made in cases involving domestic violence or child abuse or where one spouse cannot locate the other.

In order to begin a divorce in the state of Minnesota, one spouse must fill out or write a Summons and Petition for Dissolution of Marriage. Within the petition, the petitioning spouse must include information about the marriage like income, debts, children, and any property owned. After he or she fills out the petition it must then be served to the receiving spouse and filed with the District Court. Service must be done by a third party who can be a friend, the sheriff or a professional server.
After the mediator covers the rules of mediation and insures that any necessary agreements to mediate are signed, the mediator explains the mediation process. The parties or their representative may then make opening statements to identify issues and clarify perceptions. Many mediators will encourage the parties to begin a conversation during general caucus.
Sometimes the respondent cannot be “served” personally with the Summons and Petition because the petitioner does not know where he or she is and has no way to find out. In this case the petitioner can apply to the court for permission to “serve” another way—such as mailing the papers to an address where mail will likely be forwarded to the respondent or publishing a notice in a newspaper. This special service starts the legal proceedings in cases where the respondent cannot be personally served.
