Assets and liabilities can each have different tax consequences and if not properly accounted for, a settlement that might look fair on paper may turn out to be favorable to only one party and not the other. This can happen if one party trades a checking account for a 401k, confusing pre-tax with post-tax dollars, or when there are stocks involved and neither party is aware of the cost basis of a given portfolio.
Grounds which the courts in the past have recognized as valid reasons to permit out-of-state relocation are: a better job opportunity in the other state;  and joining a fiancé who resides in another state.  These reasons do not guarantee that permission will be granted, but they have been recognized as legitimate grounds for seeking such permission.
In conclusion, my advice to fathers is that they should not despair. If the children would be better off in the father’s custody, that is worth fighting for, and is winnable. I have gotten many fathers custody, even in the most dismal of predicaments. For mothers, my advice is to take nothing for granted. Against a determined father, the loss of custody is a very real possibility which you should take very seriously if custody is important to you.
There are alternative dispute resolution (ADR) methods other than mediation. Arbitration is an ADR where both sides agree that the neutral third person will decide the dispute. In arbitration, both parties can agree whether or not the arbitration decision will be enforced by the court. Arbitration might be used when you can't agree about the value of something and you're willing to let someone else, other than a judge, decide.

4. Use just one (1) attorney. Many people hire law firms to represent them, and end up in situations where more than one attorney is working on their case. This is inefficient, because each attorney involved needs to be independently educated about the case, and no attorney is as well informed as he would be if he were the only attorney on the case. Mediation in divorce is a process by which a mediator or a trained neutral, often a lawyer or mental health professional, helps divorcing spouses reach agreement. The mediator works as a facilitator to guide the divorcing spouses through the process to resolve the outstanding issues. Some divorcing spouses have reached agreement on certain issues, but need assistance resolving other ones, and they attend mediation to address just those issues. Others need assistance with all of the issues. But those who elect mediation are electing to work together to maintain control of their lives. (When individuals litigate and go to court, the judge makes the decision. Those decisions are often not what either side really wants, but once the judge makes the decision, it is the one that controls.)
Emptying the joint bank checking or savings account in anticipation of divorce would ordinarily be frowned upon, unless you had a very justifiable reason. Be warned, however, that your spouse may beat you to it. I’ve seen joint bank accounts cleaned out by the other party many times, and many times there is unapproved spending by the other spouse as the divorce approaches. Although this can be accounted-for and compensated-for in the divorce property settlement, it can still cause great difficulty if you need the money during the pendency of the proceedings and have to litigate to get any of it back.
Financial Early Neutral Evaluations (FENE) allow the parties to meet with an accountant or lawyer neutral expert to assist the parties in preparing a balance sheet and help to negotiate a division of property. These experts can also assist in preparing cash flow summaries to help the parties settle issues of child support and spousal maintenance. As with social early neutral evaluations, the neutral may advise the parties what they believe will occur if the matter is fully litigated. As with Social ENEs, many counties provide rosters of lawyers and accountants certified to assist with FENE's in that county.
The attorney representing either the petitioner or the respondent can schedule a temporary relief hearing. The other party must be served with motion papers, including a Motion for Temporary Relief and an Affidavit. Affidavits are written statements signed under oath. The motion papers are legal papers requesting temporary relief from the court and stating the facts on which the request is based. These facts include the income and expenses of each party, who has the children now and why they should be in the custody of the party asking for temporary custody. The motion papers must be mailed or handed to the other party before the hearing. There are certain time periods for giving notice to the other party before the hearing that must be followed when bringing and responding to motions. The petitioner's attorney often has the motion papers served at the same time as the Summons and Petition.
