The main advantage of mediation is that it keeps you and your spouse in control of your own divorce. That can make all the difference in your recovering from your divorce and moving on with your life. Mediation allows the two of you to get through your divorce with less conflict than you would experience in an adversarial divorce. Because mediation is all about working with shared knowledge, mediation also often allows you and your spouse to work together to lower your tax bill . . . and that can often translate to more money for you.
The court can also consider a change if the parent with custody has denied or interfered with the parenting time of the other parent. However, parenting time problems alone are usually not enough to change custody. Denying or interfering with a parenting time schedule is a factor that a court may consider in deciding to change custody. A judge can also change custody based on the “best interests of the child,” if both parents agreed to use that standard in a writing approved by the court.
Minnesota is a purely "no-fault" divorce state, meaning that you can't allege that your spouse's wrongdoing was the cause of the divorce. Instead, most divorces are based on the grounds that the parties have irreconcilable differences that have led to the breakdown of the marriage. However, fault may be considered by the court as a factor in dividing property or awarding alimony. That said, although the legal impact of the physical custody label is debatable, if you are the primary parent, it is still preferable to have sole physical custody than joint physical custody. Conversely, if you are not the primary parent, it is still preferable to have the joint physical custody label than not to have it. This is because of the uncertainty over how a future court, evaluator, parenting consultant, guardian ad litem or others might interpret that label.

After the elapse of a period of time, nobody much cares if the reason you only had every other weekend was because the other parent truly wouldn’t “let” you have more time. Although that may very well be the case, and although you may have let your spouse control the situation in order to spare the children the trauma of parental conflict, in my experience the courts are more swayed by the pattern of contact rather than by these “excuses.” The wisdom of Solomon does not apply. 
Essentially, a Social Early Neutral Evaluation is similar to mediation in that it is a form of alternative dispute resolution that is voluntary and non-binding. The difference is that with ordinary mediation, the mediator generally will not take a position. Whereas the evaluators presiding over an SENE are specifically tasked to give their recommendations, as a way to help the parties reach a settlement.
Some find it helpful to make a list of marital events, in the order they occurred, as well as a list of the current disputes and another list of the outcomes you would like to see. Whether you put it on paper or not, have a list in your head of which issues are most important to you and which are the least important. Being prepared and on time is key to the success of the divorce mediation. You must also be prepared to talk to your spouse. If you have had trouble communicating in the past, your mediator will be there to facilitate communication. While it is important that you set goals regarding what it will take to resolve the case or the individual disputes, it is equally important you remain flexible. You may be surprised at some of the things you find out during mediation which change your perception of the entire issue.
Grandparents may seek visitation with their grandchildren. Minnesota law also allows a person who is not a parent but who previously lived with the child for two years to ask the court for the right to visit the child. A court will grant visitation if it is in the child's best interests and if visitation will not interfere with the parent-child relationship.
This is usually a very smart thing to do, to prevent the other spouse from racking up debt in your name. I’ve seen it happen countless times. And while this can be accounted for, it’s much easier to just avoid the issue in the first place. Also, remember that even if the Court orders your spouse to assume this or that joint credit card debt, the Court has no authority to absolve you of your contractual liability to the creditor. So the joint debt will remain on your credit history, and will still be your problem to deal with if your spouse ever stops paying or pays late.
Sign and file a “Joint Petition for Divorce.” (Divorce court officials sometimes refer to this as the “1A form” and this divorces process as a “1A Marriage Dissolution.”) This is a divorce form that a) states when you were married and last lived together, b) identifies minor or dependent children of the marriage, c) identifies any family law court actions already in process, d) suggests an approximate date when the marriage irretrievably broke down (when it effectively ended), e) requests a divorce, and f) asks the judge to approve your “Separation Agreement” (see below).
SUPERIOR SERVICE: All mediators are not created equal! Although mediators are not decision makers, they do have a significant impact on your divorce process. Mediators set the tone and guide you through the rough patches. Therefore, it is wise to interview mediators and select one who respects your sense of fairness, recognizes the importance of self-determination, helps generate creative solutions and facilitates workable agreements.
There is one advantage to being the petitioner. If the parties reside in different counties, the petitioner determines venue (location) by filing for divorce in the county of choice. Venue can be critical because judicial views on custody and alimony vary from county to county. The respondent can request a change in venue, but will need to show a good reason for the change.
All that's required to make a divorce mediation successful is for both people to show up willing to negotiate and open to compromise. Don't reject mediation just because you and your spouse see a particular issue very differently—in other words, don't give up before you've begun. Mediation is a powerful process and many cases that seem impossible to resolve at the beginning end up in a settlement if everyone is committed to the process.
When discussing issues concerning custody parental access, think about where your kids will spend most of their time: where they go to school, where they take dance and karate and other extra-curricular activities. Think about whether they have any special needs and how you’ll care for them, how you’ll cover any private school or college costs, and where they’ll spend birthdays, holidays, and special occasions.
The court may also require that medical insurance for an ex-spouse continues. For example, group medical insurance rates may not be available to one spouse or may not cover as many medical costs as the insurance available through the other spouse's employer. The court may order that the insurance through one spouse's employer continue. Either party may be ordered to pay the cost. This kind of insurance coverage is part of spousal maintenance.

Effective August 1, 2013, the law in Minnesota allows same sex couples to get married or divorced in this state. To file for divorce in Minnesota, at least one party must be living in Minnesota for at least 180 days before starting the divorce case. A same sex couple may also file for divorce in Minnesota if they got married in Minnesota on or after August 1, 2013, and each party to the marriage now lives in a state that does not allow the dissolution of the parties' same sex marriage.
