Meditation during divorce is a way of finding solutions to issues such as child custody and spousal support. It is an alternative to formal process of divorce court. During mediation, both parties to the divorce and their attorneys meet with a court appointed third party. This third party, the “mediator” assists the parties in negotiating a resolution to their divorce.
Going through a divorce can be one of the toughest times in your life. You need a lawyer who understands what you're going through and who can help you look at the practicalities as well as the legalities you need to deal with. You need a lawyer who can be aggressive and fight for what you are entitled to, but who will also be honest with you about what is reasonable in the eyes of the law.
If there is a chance your spouse may seek an Order for Protection or Harassment Restraining Order against you — whether legitimately or fraudulently — it is important to have a plan in case you are suddenly served with one and are barred from your home, with no court hearing set for two weeks. If that happens, do you have a place to stay? Cash and important documents? A spare change of clothing?
By far, the easiest and cheapest way to complete the divorce process is if you and your spouse are in full agreement about major issues and you represent yourself. That is why you should make every effort to come to an agreement with your spouse prior to starting the divorce procedure. You will save a lot of money and effort by filing a Joint Petition for Summary Dissolution of a Marriage and fulfilling the court’s requests without legal counsel. MyDivorcePapers.com can offer valuable guidance and the forms necessary to complete this process with minimal cost and effort.
In some cases, the court may order spousal maintenance for a limited time while the spouse returns to school or trains for employment. Permanent spousal maintenance may be awarded if the court finds that one of you will not be able to adequately support yourself. The court will consider age, health, education, work experience, skills and other factors.
Fill out and file Financial Statements. These statements document a) income, b) assets (house, cars, pensions, etc.), c) living expenses, and d) debts. There is a Long Form version if your annual income is over $75,000, and a Short Form version if your annual income is below $75,000. These forms disclose financial information that is necessary for coming to an agreement on Division of Marital Assets, Child Support, and Alimony (see Separation Agreement, below).
Notwithstanding all of the above, mediation can often be the process that helps break an impasse and result in a reasonable settlement of one’s case. But for mediation to work, both parties must be prepared to compromise. If you approach mediation with the attitude that it will be an opportunity to convince the other party to do things your way, mediation will likely fail. That said, be careful not to concede too much. A lawyer can give you an appreciation for where the line is between generous cooperation and foolish capitulation.
“Your Honor, the Petitioner moved out four months ago, and since then he has only had the children every other weekend, by his own acquiescence. Now all of a sudden he wants custody [or more parenting time, as the case may be]. This is clearly a disingenuous request which should be summarily denied. The schedule the parties have been following has worked well for the children, and for the sake of their sense of stability and continuity, it should continue.”
Julia actually came to my rescue twice. The first time, I was fortunate enough to stumble across her website while looking for divorce mediation. We did not have the time or money for court battles; we just needed someone to insert some sense and sanity into what is already a tricky and painful process. Julia was able to make our divorce process simple and straightforward, and we both felt like we were heard! Four years later, I contacted Julia again to help me with the next intimidating process of amending the divorce agreement. Again, I felt like she did her conscientious best to humanize and streamline the process (and save me money!) with her compassion, quick thinking, and thorough attention to detail. And as a bonus: she answered my panicked emails in a timely and kindly fashion.
