The best way to get started is for you and your spouse to attend a free one-hour consultation. During the consultation you will receive detailed information about mediation in general and how my process would work in your unique situation. Perhaps most importantly, during this consultation you will each have the opportunity to meet me and determine whether or not you feel comfortable with me and my professional services. Another benefit is that both you and spouse receive the same information at the same time, are able to hear each other’s questions and concerns, and may experience the neutral role of the mediator. You will also receive instructions about how to prepare for your work in mediation and how to save money. If after the consultation you believe that mediation is the best choice for your situation, the next step is to schedule the first working session and begin preparing the necessary information and documentation.
If the parties are hostile or overly emotional, the mediator will separate the parties and shuttle back and forth between them in "private caucuses." A private caucus is a conference between the mediator and one party, without the other party being present. The mediator passes offers and demands between the parties. Conversations between a party and the mediator during private caucus are confidential unless a party authorizes the mediator to disclose information to the other side.

In Minnesota, Marriage Dissolution proceedings, or divorces, are viewed as "no fault" proceedings. This means that a spouse does not have to prove the other spouse was at fault or did something wrong to cause the breakdown of the marriage to obtain a divorce. Either spouse may commence a divorce action by simply alleging that there has been "an irretrievable breakdown in the marriage relationship" - in other words, that in their opinion, the marriage is dead and there is no chance of reconciliation. If one spouse feels this way, even if the other disagrees, the court will ultimately grant the dissolution of marriage. Early in the process, if you do not believe that there has been an irretrievable breakdown of the marriage, the option of marriage counseling is possible. Unfortunately, if a spouse has set their mind to divorcing the other, it is unlikely that counseling can repair the marital relationship.
In cases where the child is approaching the start of kindergarten, or will be transitioning to middle school, junior high, or high school, this can be a closer call. Obviously the quality of the school will matter. Fortunately school statistics are readily available, including standardized test scores. The Minnesota Department of Education provides School Report Cards on their website.
Fill out and file Financial Statements. These statements document a) income, b) assets (house, cars, pensions, etc.), c) living expenses, and d) debts. There is a Long Form version if your annual income is over $75,000, and a Short Form version if your annual income is below $75,000. These forms disclose financial information that is necessary for coming to an agreement on Division of Marital Assets, Child Support, and Alimony (see Separation Agreement, below).
NOTE: There are many ways to divide real estate in a divorce. The court forms for marriage dissolution (divorce) only give you 1 option -- one spouse gets 100% of the house, cabin, or other real estate, and the other spouse gets a lien. But, you can change the court forms. An attorney can explain other options, advise you about the law, and draft terms to meet your situation. If your divorce involves real estate, you should get advice from a lawyer on your legal rights and options.
