During a divorce, either party can petition the court to pay alimony or “spousal maintenance” to the other. Minnesota laws provide for this type of assistance so the lower earning spouses can maintain the same reasonable standard of living as before. Generally speaking, a court will be more inclined to order a longer period of alimony when the marriage was longer in duration.
If one of the parties is awarded ownership of the home or other real estate, the Judgment and Decree will describe exactly how the transfer is to happen. Many times, the Judgment and Decree orders the other party to sign a Quit Claim Deed. A Quit Claim Deed transfers his or her rights in the real estate to the party who was given the property. The Quit Claim Deed and the Judgment and Decree are filed with the County Recorder or Registrar of Titles. If the property is registered (called Torrens) property, the owner's duplicate certificate of title is needed. The Quit Claim Deed and the Judgment and Decree are then "memorialized" by the Registrar of Titles and a new title issued. Go over the pros and cons of mediation, as opposed to other methods. Whether it’s in person at a coffee shop, over the phone, via text messages, or through email, the first step is to agree to participate wholeheartedly. Strong-arming your spouse might get him or her to the table, but the mediation won’t be effective and you’ll end up wasting time and money.
If the respondent answers the Petition, the parties will try to settle the case by having their attorneys work out an agreement. This is called negotiation. If the couple is able to agree on everything (through negotiation or mediation), a written agreement called a Stipulation or Marital Termination Agreement is prepared and signed by both parties and their attorneys. The parties agree that one of them will present the Stipulation to the court. Just one party needs go to court. The other party usually does not attend. The court usually accepts the agreement made by the parties. A written Stipulation may also be presented to the court without the need for any hearing. This process can only be used if each party had a lawyer.
The parties may expressly preclude or limit later modification of maintenance through a stipulation, if the court makes specific findings that the stipulation is fair and equitable, is supported by consideration described in the court's findings, and that full disclosure of each party's financial circumstances has occurred. The stipulation must be made a part of the judgment and decree.
Finally, mediation can be substantially less expensive than the court process. When parties hire a mediator from Bloch & Whitehouse, P.A., they typically split our reasonable hourly rate equally between them. By contrast, if both parties hire lawyers, the cost for each party could be double or triple the cost for each party’s attorney. Moreover, significant court costs and other fees are minimized as a result of choosing mediation.
The maintenance order shall be in amounts and for periods of time, either temporary or permanent, as the court deems just, without regard to marital misconduct, and after considering all relevant factors including: (a) the financial resources of the party seeking maintenance, including marital property apportioned to the party, and the party's ability to meet needs independently, including the extent to which a provision for support of a child living with the party includes a sum for that party as custodian; (b) training to enable the party seeking maintenance to find appropriate employment, and the probability, given the party's age and skills, of completing education or training and becoming fully or partially self-supporting; (c) the standard of living established during the marriage; (d) the duration of the marriage and, in the case of a homemaker, the length of absence from employment and the extent to which any education, skills, or experience have become outmoded and earning capacity has become permanently diminished; (e) the loss of earnings, seniority, retirement benefits, and other employment opportunities forgone by the spouse seeking spousal maintenance; (f) the age, and the physical and emotional condition of the spouse seeking maintenance; (g) the ability of the spouse from whom maintenance is sought to meet needs while meeting those of the spouse seeking maintenance; and (h) the contribution of each party in the acquisition, preservation, depreciation, or appreciation in the amount or value of the marital property, as well as the contribution of a spouse as a homemaker or in furtherance of the other party's employment or business.
