The other party is often awarded a lien or a mortgage for a share of what the property is worth.  A lien is a claim on the property.  The party awarded the real estate owes the other party the amount of the lien or mortgage.  The Judgment and Decree usually sets a date by which the payment must be paid.  If the lien is not paid when due, the party owed the money can ask the court to order the other to pay the lien, or to change division of the property in the Judgment and Decree.  In the case of a mortgage, the holder of the mortgage could foreclose.
After service, the receiving spouse must file an answer. If the spouses agree on the conditions of their divorce, they may file a Stipulate Findings of Fact, Conclusions of Law, Order for Judgment and Judgment and Decree, which will put them on a proverbial fast track to ending their marriage. However, if the receiving spouse disagrees with the petitioning spouse, then he or she may serve the petitioning spouse an answer that explains why he or she disagrees.
Although there certainly are several different styles of mediation, there are several things you can depend on no matter what style your mediator uses. Mediation is flexible and confidential. It gives you and your spouse a way to settle the conflict between you, which is natural and inevitable, in a way that helps you to work together as parents after your divorce.

Infidelity can also be tough, though not impossible, to work through: In one case of Green’s, the husband had been unfaithful and in a rather public way—he was active on social media, on Tinder, and he had an alternative Facebook profile, “so he had not only cheated on her, but there was a public aspect to it, so she felt very angry, and she also felt humiliated.”
1. If custody or parenting time is in issue, don’t move out without first getting an enforceable written stipulation addressing custody and parenting time after the move-out. The key is to have in place at least an interim parenting time schedule which affords you at least as much parenting time as you hope to obtain through the court. Otherwise, the longer you acquiesce to a pattern of parenting time that is less than you desire, the more of an argument the other party will make of it against you. Often arguments like the following are heard:
Not exactly; mediated settlements do not become legally binding until they have been submitted to, and accepted by, the Court. The final product of mediation is a Memorandum of Agreement. This document memorializes all of your agreements and is the basis for your Marital Termination Agreement and Judgment and Decree. If unrepresented by attorneys, most of my clients choose to hire a neutral attorney (or scrivener) who completes all of the necessary legal documents and assists with the filing process. If either or both clients are represented, one of the attorneys may be selected for drafting the legal documents and the other attorney reviews everything for accuracy. A few of my clients choose to use the pro se forms available online through the MN District Courts website. At the conclusion of mediation, I will be able to help you determine the best option for your situation. It is important to know that even if your mediator is also an attorney, it is considered professionally unethical for a mediator to draft legal documents for his/her clients.
After the elapse of a period of time, nobody much cares if the reason you only had every other weekend was because the other parent truly wouldn’t “let” you have more time. Although that may very well be the case, and although you may have let your spouse control the situation in order to spare the children the trauma of parental conflict, in my experience the courts are more swayed by the pattern of contact rather than by these “excuses.” The wisdom of Solomon does not apply. The attorney representing either the petitioner or the respondent can schedule a temporary relief hearing. The other party must be served with motion papers, including a Motion for Temporary Relief and an Affidavit.  Affidavits are written statements signed under oath.  The motion papers are legal papers requesting temporary relief from the court and stating the facts on which the request is based.  These facts include the income and expenses of each party, who has the children now and why they should be in the custody of the party asking for temporary custody.  The motion papers must be mailed or handed to the other party before the hearing. There are certain time periods for giving notice to the other party before the hearing that must be followed when bringing and responding to motions. The petitioner's attorney often has the motion papers served at the same time as the Summons and Petition.

People often ask, “Does mediation really work?” In a word, yes. We know from years of research that when you compare couples who have mediated their divorce with couples who go through an adversarial divorce, mediating couples are more likely to be satisfied with the process and the results, likely to take less time and spend less money, and are less likely to go back to court later to fight about something.

Sign and file a “Joint Petition for Divorce.” (Divorce court officials sometimes refer to this as the “1A form” and this divorces process as a “1A Marriage Dissolution.”) This is a divorce form that a) states when you were married and last lived together, b) identifies minor or dependent children of the marriage, c) identifies any family law court actions already in process, d) suggests an approximate date when the marriage irretrievably broke down (when it effectively ended), e) requests a divorce, and f) asks the judge to approve your “Separation Agreement” (see below).

If there is a chance your spouse may seek an Order for Protection or Harassment Restraining Order against you — whether legitimately or fraudulently — it is important to have a plan in case you are suddenly served with one and are barred from your home, with no court hearing set for two weeks. If that happens, do you have a place to stay? Cash and important documents? A spare change of clothing?
1st meeting: The couple and the mediator identify the issues needed to be discussed and the order in which they will be discussed, then decide what information needs to be gathered and shared. Between the first and later sessions the couple gathers all relevant financial data, or if necessary, the opinions of experts such as appraisers or accountants, with this material treated with the same care and concern as would be the case in the adversarial process.
Court rules now require both sides to try ways other than court to resolve their differences.  There are many other ways to reach agreements called alternative dispute resolution (ADR) methods.  Make sure you know all your choices before deciding on a method.  The parties may be asked to pay for the cost of ADR. Most ADR methods let you stop the process at any time without reaching an agreement.

In most cases, divorce is a difficult and painful process, both emotionally and financially. The traditional practice of hiring a lawyer and litigating in court to end a marriage is not only expensive, but can lengthen the process, increase contention, and cause additional and unnecessary stress on you, your spouse, and your children. Because of this, more and more couples are looking to mediation to walk them through the intricacies of divorce and help navigate parenting agreements. Once a marriage is far enough gone, the only remaining question is “How hard is it going to be to untangle our legal and financial lives and (if relevant) sort out custody?” For some couples, separating via mediation rather than litigated divorce has its appeal: Many people don’t want to cast their former spouses in the role of enemy, and mediation is a cheaper, more cooperative, and less adversarial process than a War of the Roses-type brawl.
If you or your children have been hurt or threatened by your spouse, the court cannot make you mediate.  In this circumstance, the court knows that mediation wouldn't be safe or fair. For example, you might just "agree" because you're afraid of what would happen to you or your children if you didn't.  Make sure to tell your lawyer, the court or the mediator, if you have been hurt or threatened by your spouse.

The court may also require that medical insurance for an ex-spouse continues.  For example, group medical insurance rates may not be available to one spouse or may not cover as many medical costs as the insurance available through the other spouse's employer.  The court may order that the insurance through one spouse's employer continue.  Either party may be ordered to pay the cost.  This kind of insurance coverage is part of spousal maintenance.
