Conversely, there is no way to finalize your divorce through mediation alone. Even if you reach a tentative agreement in mediation, this agreement must be formalized in a written stipulation, signed by both parties and their attorneys, and ultimately approved by the Court.  This signed stipulation — not your verbal agreements from mediation sessions — is what becomes the enforceable terms of your divorce, and should be prepared or at least reviewed and revised by your lawyer before you sign.
This can be problematic if a party needs to commence a divorce in Minnesota immediately, but neither party has yet been residing here for the requisite six-month period. In such cases, one should seriously consider a legal separation, which has no length-of-residency requirement, and which can afford much of the relief afforded by divorce, such as determinations of property possession, custody, parenting time, child support, and spousal maintenance.  Later, after the six-month residence requirement is satisfied, the case can be converted to one for divorce.
After discovery is completed, the attorneys will typically work with you to formulate a settlement proposal which is presented to the other side, either as part of a settlement meeting at one of the attorney's offices, or simply through a letter sent to the other lawyer. The attorneys will prepare a balance sheet summarizing your assets and liabilities. In Minnesota, the law requires an "Equitable Division of Property," which typically, but not always indicates an equal division of property. Parenting time proposals may also suggest the future use of a "Visitation Expeditor" or "Parenting Consultant" who are neutral third parties retained to assist in resolving future parenting and parenting time disputes. When the parties have children, settlement discussions will also involve "child support", which is currently set pursuant to "child support guidelines" based on a comparison of the gross incomes of both parties, and the amount of time the children will spend with each party. If one of the parties lacks the resources to support themselves, settlement discussions will also involve requests for either temporary or permanent "spousal maintenance." Pursuant to Minnesota Law, spousal maintenance while based on a consideration of several factors, ultimately will be based upon a consideration of the marital standard of living, the needs of the spouse requesting maintenance and the ability of that spouse to meet those needs as compared to the needs of the spouse from whom maintenance is sought, and their ability to meet their own needs and still contribute to the support of the requesting spouse. Maintenance may be temporary or permanent, depending on the facts of the case, including length of marriage whether there is any uncertainty as to if the spouse requesting maintenance will ever be able to become fully self supporting.
Even under the best of circumstances, going through a divorce is one of life’s most difficult challenges – both emotionally and financially. Although using mediation may alleviate some of the most extreme negative impacts; divorce in Minnesota is never easy. I believe, the divorce process you choose (for example, mediation vs. litigation) is the most significant factor in determining the degree of suffering you are likely to endure…the more adversarial the process, the more difficult the challenge.
If one of us had an affair, how does that affect the divorce? Although it can be emotionally painful and it can devastate a relationship, an affair matters very little for the terms of the divorce . The one exception is if a spouse secretly spent thousands or tens of thousands of dollars on an affair. That counts as “marital waste” and can be calculated into the eventual division of marital assets.
2. In divorces, there is inevitably a process of “discovery,” where each party requests information and documents from the other party. Sometimes this is informal and limited. Other times it is formal, comprehensive, and terribly time-consuming for the parties themselves (to gather the information), and for their lawyers (who must review the responses and put them together in proper legal form). Because most attorneys are sloppy and lazy with formal discovery, they request much more than is really necessary to settle a case, just to cover their butts and to avoid the work of tailoring the discovery demands to each particular case, or just to make the process more onerous for the other party.

The best mediators have both a high level of experience and knowledge about divorce and family law and a calm and diplomatic approach to the situation and towards each of the parties. Mediators who have spent many years as attorneys, representing clients in mediations and litigations, have had the opportunity to see many situations and many types of resolutions. As mediators, they are often able to help clients think outside the box and craft creative solutions. They can also offer perspective on how similar cases have been perceived by the courts. But the mediators approach in presenting this information is also critical. Mediators need to be able to rise above the emotion and conflict that is often present, and help the parties see what is and isn’t relevant to resolving their case.

Notwithstanding all of the above, mediation can often be the process that helps break an impasse and result in a reasonable settlement of one’s case. But for mediation to work, both parties must be prepared to compromise. If you approach mediation with the attitude that it will be an opportunity to convince the other party to do things your way, mediation will likely fail. That said, be careful not to concede too much. A lawyer can give you an appreciation for where the line is between generous cooperation and foolish capitulation.
If the parties can not come to an agreement on how their marital property is to be divided, the court shall base its findings on all relevant factors including the length of the marriage, any prior marriage of a party, the age, health, station, occupation, amount and sources of income, vocational skills, employability, estate, liabilities, needs, opportunity for future acquisition of capital assets, and income of each party. The court shall also consider the contribution of each in the acquisition, preservation, depreciation or appreciation in the amount or value of the marital property, as well as the contribution of a spouse as a homemaker. It shall be conclusively presumed that each spouse made a substantial contribution to the acquisition of income and property while they were living together as husband and wife. If there is a substantial change in value of an asset between the date of valuation and the final distribution, the court may adjust the valuation of that asset as necessary to effect an equitable distribution. (Minnesota Statutes - Chapters: 518.58)
While there are certainly divorcing spouses who can barely stand to be in the same room with one another, a large number of those going through a divorce will have a better outcome if the case is resolved through compromise and agreement rather than a long, drawn-out litigation. Mediation allows this to happen through the facilitation of resolutions which both parties are satisfied with. In fact, there are numerous advantages of mediation over court litigation when resolving disputes among divorcing couples.
This is usually a very smart thing to do, to prevent the other spouse from racking up debt in your name. I’ve seen it happen countless times. And while this can be accounted for, it’s much easier to just avoid the issue in the first place. Also, remember that even if the Court orders your spouse to assume this or that joint credit card debt, the Court has no authority to absolve you of your contractual liability to the creditor. So the joint debt will remain on your credit history, and will still be your problem to deal with if your spouse ever stops paying or pays late.
Another common complaint is that the system is too soft on child support obligors. Truth be told, there are some self-employed parents that are doing well financially, but whose "inaccurate" tax returns show little income after they’ve written off business expenses (e.g., cars, travel and entertainment). Sometimes, these parents are able to fool the system and pay a lower amount of support.
The big warning I have is this: years ago, when the program started, the idea was that the evaluators would give their opinion of how they would likely decide the case in a full-blown custody evaluation, based on the facts learned in the SENE. This honest appraisal of how a months-long custody evaluation would likely turn out is what helped parties to settle their cases.
You can also go to court to get an order to change or set a parenting time schedule or for supervised parenting time. The court may send you to a parenting time expeditor before the court hears your motion for a change in parenting time. The court can order mediation or you can voluntarily agree to use mediation to try to resolve parenting time problems. If one parent denies parenting time, the other parent can go to court to request more parenting time or even to change custody. The court will look at whether or not there was a good reason for denying parenting time. Abuse of the children would likely be a good reason to deny parenting time.
A mediator’s job is to get you to reach an agreement. Their sense of professional fulfillment is satisfied when an agreement is reached. Unfortunately, all too often, this can result in a person agreeing to things that are contrary to his or her interests, contrary to what the Court would order, and — in the worst case — contrary to the best interests of the children. Therefore, it is critically important to either have an attorney with you at the mediation session, or at least have one on retainer at the time, to consult before you agree to anything.
Each divorce mediator will have his or her own approach, however, some of the basics will likely remain the same. You will probably speak to the mediator on the phone, providing information about your marriage your family and the issues at hand. Some mediators will ask you for a great deal of information, while others may prefer to stick with the basics until meeting both parties. During the first meeting, the mediator will explain how the divorce mediation process will proceed. All parties may meet in the same room at all times, or the mediator may meet with each party separately at least one time.

In order to begin a divorce in the state of Minnesota, one spouse must fill out or write a Summons and Petition for Dissolution of Marriage. Within the petition, the petitioning spouse must include information about the marriage like income, debts, children, and any property owned. After he or she fills out the petition it must then be served to the receiving spouse and filed with the District Court. Service must be done by a third party who can be a friend, the sheriff or a professional server.
In today's depressed real estate market, I often encounter the situation where a spouse had a non-marital interest in the marital homestead at the time of marriage; but at the time of divorce, the house is upside down. So the question arises as to whether or not the spouse who formerly had the non-marital interest is entitled to any kind of credit in the overall divorce property settlement.
No case is too complicated to be settled using mediation. Often times the “complicated” cases are the cases which in the context of the adversarial legal system, cost the most, last the longest and create the most extreme long-term negative impacts for all involved. In all of the states we practice in, both equitable distribution states and community property states, the parties are encouraged to actively participate in, and come to agreement on, the fair division of their marital assets and liabilities. But unless you and your spouse are experts in the financial matters pertaining to divorce, this can be a dangerous path to walk.

For married parties with children born during the marriage, both parties have joint legal and physical custody until the Court orders otherwise. Thus, either parent has the right to take the children, and the other parent has the right to take them back, and so forth. This can lead to a lot of game-playing and tugs-o-war which are obviously harmful to the children.
This is based on the outdated belief that women know less about the marital finances than their husbands, therefore will not be left with a favorable outcome in the divorce. It is important to remember divorce mediators are neutral and have no interest in either spouse “winning.” Finally, most people believe couples who are barely speaking could not possibly benefit from divorce mediation. Divorce mediators are highly trained in alternative dispute resolution and are skilled at working with those who have significant levels of anger between them. Obviously, both parties will be required to speak at some point, but the divorce mediator may be able to help that happen.
If you and your spouse are splitting up, one question you may be asking is, “how will I support myself?” In this era of dual income families, when you get a divorce or legal separation, you often times also lose a portion of the source of your monthly rent, mortgage, bills, and more. This can often be a deterrent for people to get a divorce – even when they desperately need one. Lawmakers in Minnesota, as in all states, have allowed for spouses to petition the court for what is known as “alimony.”
4. Use just one (1) attorney. Many people hire law firms to represent them, and end up in situations where more than one attorney is working on their case. This is inefficient, because each attorney involved needs to be independently educated about the case, and no attorney is as well informed as he would be if he were the only attorney on the case. I’ve seen billing statements from other firms with numerous charges for a “strategy conference” between attorneys in the same firm. I’ve seen billings for two attorneys from the same firm attending the same deposition. Obviously these duplicative charges don’t happen when you use a single attorney for your case.
1. If custody or parenting time is in issue, don’t move out without first getting an enforceable written stipulation addressing custody and parenting time after the move-out. The key is to have in place at least an interim parenting time schedule which affords you at least as much parenting time as you hope to obtain through the court. Otherwise, the longer you acquiesce to a pattern of parenting time that is less than you desire, the more of an argument the other party will make of it against you.
