You are not obligated to hire an attorney in order to file for divorce; however, having one greatly improves the likelihood your rights will be protected and that your divorce is done correctly. Otherwise, you may end up spending much more on hiring an attorney after your divorce to seek post-decree modifications to clean up anything done improperly at the outset. Having a lawyer with you during this process also lessens the pressure on you during this difficult time. Further, hiring a lawyer is especially beneficial if there are allegations of abuse — spousal, child, sexual or substance abuse — because in those situations, it may be impossible for the abused spouse to negotiate effectively. A lawyer can help arrange the necessary protection for an abused spouse and the children. There are many other instances where a lawyer will be significantly helpful in a divorce, such as: asserting a non-marital claim, complex finances, divorces involving business ownership, divorces involving one spouse living in a different state, and many more instances.
I’ve heard of cases in which one spouse is so eager for custody of the children that they will relieve the other spouse of any duty to pay child support—which is not in their or the children’s best interests. Green says, “This is explicitly contrary to New York legislative policy—the kids shouldn’t be bargained for the money. The two things are determined separately by the court, so there’s no reason to take less than you’re entitled to under the formula.”
To get a no-fault dissolution in Minnesota, you need to state in the Petition for Dissolution of Marriage that “there has been an irretrievable breakdown in the marriage relationship.” Also, one of the following must exist: (1) serious marital discord adversely affecting the attitude of one or both of the parties toward the marriage, or (2) the parties have been living separate and apart for 180 days before filing.
Then there are the parties who fall into the trap of thinking the best way to divide up assets and liabilities is by splitting each item down the middle. That can lead to thousands of dollars in additional fees that wouldn’t have been necessary if they had waited for an expert mediator skilled in the finances of divorce to offer alternative more efficient options.

In some cases, a spouse may be reluctant to attend mediation due to misperceptions they have regarding the mediation process. One party may feel the mediator will decide crucial issues without input. In reality, a divorce mediator cannot compel either spouse to do—or refrain from doing—anything. Others may feel a mediator can single-handedly “fix” all issues in the divorce. If one spouse fails to disclose all relevant facts related to the case, the mediator will be unable to achieve real results. In some cases, women may feel their husband will fare better during the mediation.
People often ask, “Does mediation really work?” In a word, yes. We know from years of research that when you compare couples who have mediated their divorce with couples who go through an adversarial divorce, mediating couples are more likely to be satisfied with the process and the results, likely to take less time and spend less money, and are less likely to go back to court later to fight about something.
You may be surprised to know that most MN divorce cases (over 90%) are settled before they ever reach a court room. Mediation is so effective that the State of Minnesota requires you make a good faith effort to settle your divorce through Alternative Dispute Resolution (ADR) before appearing in Court – so why not start with a process which is proven to work as well, if not better, than litigation?
For unmarried parents, the mother has sole legal and physical custody unless and until the Court orders otherwise, pursuant to Minnesota Statute section 257.75, subdivision 3. Nevertheless, a mother should be careful before denying parenting time, because one of the many factors which the court considers in determining permanent custody is “the disposition of each parent to encourage and permit frequent and continuing contact by the other parent with the child.” Minn. Stat. § 518.17, Subd. 1(13).
A mediator is a neutral professional specially trained to help you and your spouse reach agreement about all the important legal issues relating to your divorce. A mediator is not a decision maker. As your mediator, I guide you through the divorce process. I answer your questions and help you understand the court system. I facilitate a productive discussion of the issues while maintaining a safe and respectful environment. I assist you in understanding each other’s needs, wants and concerns. I help you generate and consider creative options. If you have minor children, I help you create a comprehensive Parenting Plan which will increase your likelihood of parenting success after your divorce is final. And finally, I document your agreements in a Memorandum of Agreement.
Typically the SENE will involve both parties, both attorneys, and two court-appointed custody evaluators. Usually three hours is blocked for a session. During the session, each party (and his or her attorney) is given the opportunity to explain what they would like for a custody and parenting time arrangement, and why. Questions from the evaluators are asked and answered. Then there is a break while the evaluators confer. Then the meeting reconvenes and recommendations are given and explained, whereupon the parties discuss settlement.
State of Minnesota, District Court, County of __________, __________ Judicial District. This is the Minnesota court where the dissolution of marriage will be filed. The court will assign a case number and have jurisdictional rights to facilitate and grant the orders concerning, but not limited to: property and debt division, support, custody, and visitation. The name of the court is clearly represented at the top of all documents that are filed.
Notwithstanding all of the above, mediation can often be the process that helps break an impasse and result in a reasonable settlement of one’s case. But for mediation to work, both parties must be prepared to compromise. If you approach mediation with the attitude that it will be an opportunity to convince the other party to do things your way, mediation will likely fail. That said, be careful not to concede too much. A lawyer can give you an appreciation of where the line is between generous cooperation and foolish capitulation.
With respect to financial issues, this same rule applies, as modified by the additional consideration of attorney’s fees. For example, it might be very likely that the court would award you $10,000 more in assets than your spouse is proposing, but if it will cost you $20,000 in attorney’s fees to litigate over it, it doesn’t make much sense from a purely practical, financial standpoint to do so.
If your spouse tries to conceal assets, it will not benefit them. Courts do not look favorably on dishonesty. Further, divorce attorneys can use a variety of tactics to uncover assets and income, such as formal or informal discovery requests, subpoenas, contempt motions, etc. Finally, even if you find out that your spouse concealed property after the divorce is final, the Court has the discretion to reopen the proceeding and distribute or redistribute property accordingly.
Legally, there can be no discrimination based on the sex of the parent. For a father willing to bear the time and expense of the contest, chances for custody are more or less equal to those of the mother, all else being equal. Having said that, I do think there is some lingering bias, even though judges and custody evaluators and guardians ad litem will always deny it. Often I do not believe it even occurs on a conscious level. Yet there is a gut feeling one gets, representing a father, that the job is just a little more difficult, or representing a mother, that the job is just a little bit easier.
Divorcing spouses who have a business may find it even harder to ensure their business continues to run smoothly during this difficult time. Family issues can intrude into the workplace, and if the business is shared by one spouse’s family, the tensions can increase exponentially. In this instance, divorce-mediation can help the spouses sort through the issues related to the business without costly litigation which also compromises the future of the business.

If the respondent answers the Petition, the parties will try to settle the case by having their attorneys work out an agreement. This is called negotiation. If the couple is able to agree on everything (through negotiation or mediation), a written agreement called a Stipulation or Marital Termination Agreement is prepared and signed by both parties and their attorneys. The parties agree that one of them will present the Stipulation to the court. Just one party needs go to court. The other party usually does not attend. The court usually accepts the agreement made by the parties. A written Stipulation may also be presented to the court without the need for any hearing. This process can only be used if each party had a lawyer.
If you own your home or other land, this property must also be divided fairly. The court may order the property sold so that each of you will have your share as soon as possible. The court might award one spouse the home and give the other spouse other property, such as retirement accounts, that equal the equity in the home. If the court believes that it would be better for the minor children to remain in the home, it may permit the children and the custodial parent to remain in the home until the children are 18 years old. Then the proceeds from the sale of the home will be split.
Once the mediator has helped the spouses frame the issues and interests clearly, it is time to negotiate an acceptable settlement. This usually begins with an exploration of possible options. With the mediator’s help, the spouses discuss and evaluate the options, until eventually they narrow down the options to the ones that work best for both spouses. Getting to the final combination of options will involve compromises and concessions on both sides
If the respondent does not answer the Petition within 30 days after it was served, the respondent is in default. The petitioner's attorney tells the court and a default hearing is scheduled. Default hearings are also scheduled when all of the relief to be ordered by the court has been agreed to by the parties in a written agreement called a Stipulation or Marital Termination Agreement. If both parties are represented by lawyers, the divorce may be finalized without a hearing. If both parties did not have lawyers or if the respondent never answered, there is a default hearing. At a default hearing only the petitioner and his or her attorney need to attend. The petitioner is sworn under oath and testifies to all the facts necessary for the court to order the relief requested in the Petition or Stipulation.
In addition to the child support guidelines, the court shall take into consideration the following factors in setting or modifying child support or in determining whether to deviate from the guidelines: (1) all earnings, income, and resources of the parents, including real and personal property, but excluding income from excess employment of the obligor or obligee (2) the financial needs and resources, physical and emotional condition, and educational needs of the child or children to be supported; (3) the standard of living the child would have enjoyed had the marriage not been dissolved, but recognizing that the parents now have separate households; (4) which parent receives the income taxation dependency exemption and what financial benefit the parent receives from it; (5) the parents' debts; (6) the obligor's receipt of public assistance under the Aid to Families with Dependent Children (AFDC) program. As mentioned above, the court is going to ask what Alternative Dispute Resolution you have used prior to coming to court. In most cases, some type of ADR is required, but there are exceptions, such as some cases involving domestic violence. In recent years many mediators have developed better protocols for accommodating those circumstances, and so some cases involving domestic violence do proceed with mediation today. A victim of domestic violence should seek the advice of counsel regarding any ADR process they are considering.
A party who is dissatisfied with the court's decision may ask the trial judge to change his or her decision or set a new trial or appeal to the Court of Appeals. No new evidence or testimony is taken by the Court of Appeals. Appeals are hard to win. Usually when the Court of Appeals overrules a trial judge, it is because the Court of Appeals believes the trial judge made a mistake about the law.
