Mediation is paid by the hour, and the parties generally split the fees equally, or pay the fee out of a joint account. The fees are paid in full either in advance or on the day of mediation. If the parties don’t finalize an agreement during the mediation, the fees paid may include time for the mediator to prepare a written summary, which is provided to both parties.
During this stage, the mediator may first begin to discuss the general legal rules that might apply to your case. This can include the laws of your state dictating how a judge would divide your assets and debts, how child custody and child support would be decided, when and how alimony can be ordered, and laws dealing with related issues like taxes and life and health insurance. This general legal information will help you decide how to approach the issues in your case.
If you want to exchange the product you ordered for a different one, you must request this exchange and complete your replacement order within 60 days of purchase. The purchase price of the original item, less any money paid to government entities, such as filing fees or taxes, or to other third parties with a role in processing your order, will be credited to your LegalZoom account. That said, although the legal impact of the physical custody label is debatable, if you are the primary parent, it is still preferable to have sole physical custody than joint physical custody. Conversely, if you are not the primary parent, it is still preferable to have the joint physical custody label than not to have it. This is because of the uncertainty over how a future court, evaluator, parenting consultant, guardian ad litem or others might interpret that label.
If one of the parties is awarded ownership of the home or other real estate, the Judgment and Decree will describe exactly how the transfer is to happen. Many times, the Judgment and Decree orders the other party to sign a Quit Claim Deed. A Quit Claim Deed transfers his or her rights in the real estate to the party who was given the property. The Quit Claim Deed and the Judgment and Decree are filed with the County Recorder or Registrar of Titles. If the property is registered (called Torrens) property, the owner's duplicate certificate of title is needed. The Quit Claim Deed and the Judgment and Decree are then "memorialized" by the Registrar of Titles and a new title issued. If the Quit Claim Deed is not signed and provided, you should check with an attorney and/or the County Recorder or Registrar of Titles to find out what to do.
Minnesota is a “no-fault” divorce state. What this means is that neither spouse has to prove marital misconduct (such as infidelity) to obtain a divorce. Instead, the parties can simply acknowledge that there has been an “irretrievable breakdown” of the marriage. In Minnesota, either spouse can get a divorce if they wish to have one. A spouse does not need to “give” the other spouse a divorce; rather, it can be obtained with or without the other spouse’s cooperation.
Judges frequently say that if both people are unhappy with the judgment, it’s a good one. In the context of divorce this philosophy is even more appropriate as there are no winners when a marriage ends. Whether in court or in the mediation room, 100% mutual satisfaction with decisions and agreements is rare. As a mediator I believe that my clients are best qualified to determine what is “fair” regarding the restructuring of their lives. I encourage my clients not to define success by happiness or victory; but rather by the effectiveness of the process.

If you have been ordered to pay child support and your situation has changed so that you cannot pay the amount of support ordered, it is important to contact the county child support officer right away. You can bring a motion to ask the court to lower your child support. If you do not bring a motion, there is little chance the court will forgive back support, even if you were unable to pay. The first opportunity for the Court to decide custody is normally at the temporary relief hearing. In Hennepin County, this can easily be four months or more from the date of filing. In other counties, it can be much speedier, as in Dakota or Scott County, where a temporary relief hearing date is normally available within about 3 weeks. Once the motions for temporary relief are heard, the Court has 90 days to rule, although they normally get temporary orders out within two to four weeks.
If any issue pertinent to a custody or parenting time determination, including parenting time rights, is unresolved, the matter may be set for mediation of the contested issue prior to, concurrent with, or subsequent to the setting of the matter for hearing. The purpose of the mediation proceeding is to reduce acrimony which may exist between the parties and to develop an agreement that is supportive of the child's best interests. The mediator shall use best efforts to effect a settlement of the custody or parenting time dispute, but shall have no coercive authority.
A divorce can get complicated if the parties have property (real estate, automobiles, vacation property, pensions, jewelry, etc.) or minor children. Usually, the divorce can be done more quickly if the spouses agree on how to divide the property and handle custody and parenting time with the children. Many cases start out with a lot of disputes, but then the parties are able to reach an agreement. Parties often reach agreement after using alternative dispute resolution (ADR) services outside of court. NOTE: If you feel threatened by or unsafe with the other party, you may want to get legal advice or help from an advocate before using ADR.
