The law allows parents to make voluntary parenting plans. A parenting plan is a plan voluntarily designed by both parents based on the best interests of the child. A parenting plan must include a schedule of the time each parent spends with the child, who will make specific decisions regarding the child, and a way to settle disputes. An agreed-upon parenting plan may use terms other than “physical” and “legal” custody but it must clearly state if the parents have joint legal custody or joint physical custody or which parent has sole legal custody or sole physical custody.
Divorce is actually a legal procedure between you and your spouse, so, in order to satisfy legal requirements, you must properly notify your spouse that legal action is being taken against them. In a divorce proceeding, this is called Service of Process, and involves delivering copies of the Petition for Dissolution of Marriage and Summons along with supporting documents to your spouse in a timely manner.
In some cases, a spouse may be reluctant to attend mediation due to misperceptions they have regarding the mediation process. One party may feel the mediator will decide crucial issues without input. In reality, a divorce mediator cannot compel either spouse to do—or refrain from doing—anything. Others may feel a mediator can single-handedly “fix” all issues in the divorce. If one spouse fails to disclose all relevant facts related to the case, the mediator will be unable to achieve real results. In some cases, women may feel their husband will fare better during the mediation.
Once a decision to start a divorce action is made, one party will serve two documents, one titled "summons" the other titled "petition". The person starting the action is referred to as the petitioner; the other party will thereafter be referred to as the respondent. Occasionally, however, in very amicable divorces the parties may agree to act as "co-petitioners." A petition most typically is served by having a person other than the petitioner hand a copy of the petition to the respondent. It occasionally can also be served by mail subject to certain requirements. Many times, arrangements can be made ahead of time so that your spouse is aware of the time and location he or she will be served with a summons and petition, although unfortunately sometimes service comes as a complete surprise.
In some cases, the court may order spousal maintenance for a limited time while the spouse returns to school or trains for employment. Permanent spousal maintenance may be awarded if the court finds that one of you will not be able to adequately support yourself. The court will consider age, health, education, work experience, skills and other factors.
This is a common fear which is rooted in the adversarial legal system. The reality is that many parents who are mediating their divorce separate before the divorce is final, some even purchase a second home. Living together after a decision has been made to divorce is extremely difficult. Separation provides many people the distance they need to more successfully manage the challenges and difficulties of divorce. During mediation you have many opportunities to be creative and solve problems in a cooperative and mutually beneficial manner.
Many of the facts and circumstances that a divorcing spouse feels are important, are likely to be of little importance to the court. It‘s unrealistic to assume a judge can review all of the circumstances that led to the divorce. The issues are simply too complex, the court lacks time to hear all of it, and in the end, they aren’t usually relevant to the case, especially in a no-fault state like Minnesota.
The court will order a reasonable amount of child support to be paid by the non-custodial parent. Minnesota law has guidelines that say how much support should be paid. The court can also order either parent to pay medical insurance premiums or expenses and to pay part of child care costs. The court considers the parent's income or ability to earn income and the number of children supported.
In the mediation process, your mediator will provide you with much of the information and legal background that you need to discuss your issues. At times though, because the mediator must remain neutral, they cannot give either party advice specific to their best interests because that would be against the interests of the other party. Here, a consulting attorney, that is accessed on a limited, as-needed basis, can provide that specific legal advice to help a party decide how to best move forward in the negotiations.
Many metropolitan counties, as well as more and more outstate counties, have developed several innovative tools aimed at facilitating quick resolution of traditionally volatile areas - custody/parenting time and economic disputes. If the court is advised a custody/parenting time is present, the judicial officer will suggest that the parties participate in an "Early Neutral Custody Evaluation," referred to as a Social Early Neutral Evaluation "SENE" or in some counties and in others a Custody and Parenting Time Early Neutral Evaluation "CPENE." In this process the parties and counsel will be quickly scheduled to meet with two experts on child custody matters, one male and one female. Many counties have rosters listing the names of people certified to act as an Early Neutral Custody Evaluator. The parties and counsel will meet for three hours with the evaluators, with each party then afforded the opportunity to explain their role in raising the children, and what type of a parenting schedule they believe to be in their children's best interests. The two evaluators will then briefly adjourn, and then return to advise the parties what recommendation would result from a full custody evaluation. Many parties are able to reach a settlement of most parenting time issues after hearing this informal report.
Legally, there can be no discrimination based on the sex of the parent. For a father willing to bear the time and expense of the contest, chances for custody are more or less equal to those of the mother, all else being equal. Having said that, I do think there is some lingering bias, even though judges and custody evaluators and guardians ad litem will always deny it. Often I do not believe it even occurs on a conscious level. Yet there is a gut feeling one gets, representing a father, that the job is just a little more difficult, or representing a mother, that the job is just a little bit easier.
