If you own your home or other land, this property must also be divided fairly.  The court may order the property sold so that each of you will have your share as soon as possible.  The court might award one spouse the home and give the other spouse other property, such as retirement accounts, that equal the equity in the home.  If the court believes that it would be better for the minor children to remain in the home, it may permit the children and the custodial parent to remain in the home until the children are 18 years old.  Then the proceeds from the sale of the home will be split. 
Mediation is paid by the hour, and the parties generally split the fees equally, or pay the fee out of a joint account.    The fees are paid in full either in advance or on the day of mediation.  If the parties don’t finalize an agreement during the mediation, the fees paid may include time for the mediator to prepare a written summary, which is provided to both parties.
Then there are the parties who fall into the trap of thinking the best way to divide up assets and liabilities is by splitting each item down the middle. That can lead to thousands of dollars in additional fees that wouldn’t have been necessary if they had waited for an expert mediator skilled in the finances of divorce to offer alternative more efficient options.

Minnesota is an equitable division state. In an equitable division state, each spouse owns the income he or she earns during the marriage, and also has the right to manage any property that's in his or her name alone. But at divorce, whose name is on what property isn't the only deciding factor. Instead, the judge will divide marital property in a way that the judge considers fair, but won't necessarily be exactly equal.

In addition, a finding of irretrievable breakdown must be supported by evidence that either a) the parties have lived separate and apart for a period of not less than 180 days immediately preceding the date of service of the divorce petition; OR b) there is “serious marital discord adversely affecting the attitude of one or both of the parties toward the marriage.” [5]

During this stage, the mediator may first begin to discuss the general legal rules that might apply to your case. This can include the laws of your state dictating how a judge would divide your assets and debts, how child custody and child support would be decided, when and how alimony can be ordered, and laws dealing with related issues like taxes and life and health insurance. This general legal information will help you decide how to approach the issues in your case.

Your attorney will have referrals to local mediators. If you're representing yourself, you'll have to locate a divorce mediator on your own. If you can, try to find recommendations from someone whose judgment you trust. You can ask lawyers, financial advisers, therapists, or spiritual advisers for referrals, as well as friends who've been through a divorce. If you can't find direct, personal referrals, here are some other ideas:
The other party is often awarded a lien or a mortgage for a share of what the property is worth.  A lien is a claim on the property.  The party awarded the real estate owes the other party the amount of the lien or mortgage.  The Judgment and Decree usually sets a date by which the payment must be paid.  If the lien is not paid when due, the party owed the money can ask the court to order the other to pay the lien, or to change division of the property in the Judgment and Decree.  In the case of a mortgage, the holder of the mortgage could foreclose.
The attorney representing either the petitioner or the respondent can schedule a temporary relief hearing. The other party must be served with motion papers, including a Motion for Temporary Relief and an Affidavit.  Affidavits are written statements signed under oath.  The motion papers are legal papers requesting temporary relief from the court and stating the facts on which the request is based.  These facts include the income and expenses of each party, who has the children now and why they should be in the custody of the party asking for temporary custody.  The motion papers must be mailed or handed to the other party before the hearing. There are certain time periods for giving notice to the other party before the hearing that must be followed when bringing and responding to motions. The petitioner's attorney often has the motion papers served at the same time as the Summons and Petition.
If you were served with a "Summons and Petition" (you are the Respondent), you should talk to an attorney before you sign the "Answer and Counterpetition," and before you sign a "Stipulated Findings of Fact, Conclusions of Law, Order for Judgment and Judgment and Decree" (which is an agreement with your spouse on how to divide all assets and debts).
