It is important to understand that each case is unique; however, a number of key factors influence the length (and cost) of your process. The first factor is preparation. Completing the requested preparations in advance and supplying the necessary documentation allows us to move more quickly. The second factor is complexity. Certain situations are simply more complicated to work through than others. That said, even the most complicated cases can be settled through mediation. During your free consultation, I am typically able to identify potentially complicating factors. Third is emotional readiness and conflict. Often times divorcing spouses are in a different stage of readiness; these differences can lead to conflict which may lengthen the time needed to resolve the issues. When you both feel ready to move forward and you are able to discuss the issues without a lot of conflict the process tends to move more quickly. Regardless of your particular situation, I am committed to helping all of my clients complete mediation as efficiently and cost effectively as possible, and believe that taking a divorce education class prior to beginning any divorce process can greatly increase your likelihood of success and efficiency.
During this stage, the mediator may first begin to discuss the general legal rules that might apply to your case. This can include the laws of your state dictating how a judge would divide your assets and debts, how child custody and child support would be decided, when and how alimony can be ordered, and laws dealing with related issues like taxes and life and health insurance. This general legal information will help you decide how to approach the issues in your case.
Just because an asset is titled in one spouse’s name does not mean that asset belongs exclusively to the title-holding spouse. How you acquired the property determines whether property is marital or nonmarital, which determines how (or whether) the property will be divided. Marital property includes assets purchased or paid for during a marriage. Marital property will usually be divided between spouses. Non-marital property is different, however. Nonmarital property includes assets that are acquired by only one spouse, either as a gift or inheritance, as property the individual brought into the marriage, or in some instances, that one party acquired alone during the marriage. An attorney can help you figure out what property is marital and what is not. An attorney can also advise you about how to protect your assets in a divorce.
Mediation sessions are typically 2 – 3 hours long and scheduled approximately 2 weeks apart. Most of my clients reach a complete settlement in between 6 – 8 hours of mediation occurring over a 6 – 8 week period of time. Depending on the county in which you live and the time of year, processing of your legal documents can take the court another 1 – 8 weeks.
The small hourly cost for the attorney’s time is well worth the expense as it helps the client to make decisions and thereby move the mediation forward. In addition, at the point in the process when the parties have finalized all their agreements and a draft Separation Agreement is prepared, it is advisable that both parties review that agreement with their own attorney before they sign it. After all, this document will have lasting impact on their finances, their children, and their lives for some time to come, and it is prudent and wise to be sure that they both fully understand the terms in the agreement and that it accurately reflect their wishes.
If one of the parties is awarded ownership of the home or other real estate, the Judgment and Decree will describe exactly how the transfer is to happen. Many times, the Judgment and Decree orders the other party to sign a Quit Claim Deed. A Quit Claim Deed transfers his or her rights in the real estate to the party who was given the property. The Quit Claim Deed and the Judgment and Decree are filed with the County Recorder or Registrar of Titles. If the property is registered (called Torrens) property, the owner's duplicate certificate of title is needed. The Quit Claim Deed and the Judgment and Decree are then "memorialized" by the Registrar of Titles and a new title issued. If the Quit Claim Deed is not signed and provided, you should check with an attorney and/or the County Recorder or Registrar of Titles to find out what to do.
In reality, because mediation is such an adaptable and holistic approach to divorce, these common concerns are all well handled in the mediation setting. In fact, almost any divorce case, or really any family law matter, is suitable for mediation and the parties can successfully resolve their issues without the great expense and emotional costs of litigating.
You’ll also want to gather records for all income sources: paystubs, self-employment profit and loss statements, pension disbursements, social security, alimony and child support payments received. As for expenses, you’ll want to list your recurring expenses as well as ongoing liabilities, so that all mortgage payments, car loans, health insurance costs, food, utilities, student loans, credit card payments, etc. are known.

Although there are many types of mediation, the mediator’s role in general is to remain neutral; she cannot give advice to either party, nor can she act as either party’s attorney. However, the mediator can and does allow the parties to exchange information and encourage a level of trust in the other party and in the process so that parties can best find a solution that suits both parties.
Mediation is one of the most frequently used methods of negotiating a divorce settlement. In divorce mediation, you and your spouse—or, in some cases, the two of you and your respective lawyers—hire a neutral third party, called a mediator, to meet with you in an effort to discuss and resolve the issues in your divorce. The mediator doesn't make decisions for you, but serves as a facilitator to help you and your spouse figure out what's best.

Some find it helpful to make a list of marital events, in the order they occurred, as well as a list of the current disputes and another list of the outcomes you would like to see. Whether you put it on paper or not, have a list in your head of which issues are most important to you and which are the least important. Being prepared and on time is key to the success of the divorce mediation. You must also be prepared to talk to your spouse. If you have had trouble communicating in the past, your mediator will be there to facilitate communication. While it is important that you set goals regarding what it will take to resolve the case or the individual disputes, it is equally important you remain flexible. You may be surprised at some of the things you find out during mediation which change your perception of the entire issue.
The belief that the mediator will act as a quasi-judge and tell the people what they are going to do is another very common misunderstanding that I hear about the divorce mediation process. In actual fact, one of the greatest advantages of the mediation process is that the parties themselves retain control over all decisions made and agreements reached. This is very different from the litigation model where a judge, essentially a stranger in a black robe, imposes orders and judgments on the parties.
If you do move out, take steps to guard against destruction of property. Videotape the contents of the home (e.g., furniture, art and other valuables) and make copies of important documents (birth certificates, account statements, deeds and insurance policies) before you leave. You may also consider taking your own family heirlooms and other personal, irreplaceable items with you.
After discovery is completed, the attorneys will typically work with you to formulate a settlement proposal which is presented to the other side, either as part of a settlement meeting at one of the attorney's offices, or simply through a letter sent to the other lawyer. The attorneys will prepare a balance sheet summarizing your assets and liabilities. In Minnesota, the law requires an "Equitable Division of Property," which typically, but not always indicates an equal division of property. Parenting time proposals may also suggest the future use of a "Visitation Expeditor" or "Parenting Consultant" who are neutral third parties retained to assist in resolving future parenting and parenting time disputes. When the parties have children, settlement discussions will also involve "child support", which is currently set pursuant to "child support guidelines" based on a comparison of the gross incomes of both parties, and the amount of time the children will spend with each party. If one of the parties lacks the resources to support themselves, settlement discussions will also involve requests for either temporary or permanent "spousal maintenance." Pursuant to Minnesota Law, spousal maintenance while based on a consideration of several factors, ultimately will be based upon a consideration of the marital standard of living, the needs of the spouse requesting maintenance and the ability of that spouse to meet those needs as compared to the needs of the spouse from whom maintenance is sought, and their ability to meet their own needs and still contribute to the support of the requesting spouse. Maintenance may be temporary or permanent, depending on the facts of the case, including length of marriage whether there is any uncertainty as to if the spouse requesting maintenance will ever be able to become fully self supporting.
If your spouse tries to conceal assets, it will not benefit them. Courts do not look favorably on dishonesty. Further, divorce attorneys can use a variety of tactics to uncover assets and income, such as formal or informal discovery requests, subpoenas, contempt motions, etc. Finally, even if you find out that your spouse concealed property after the divorce is final, the Court has the discretion to reopen the proceeding and distribute or redistribute property accordingly.
This can be a very complex situation. A spouse can hide a lot of income through a business, which can greatly affect what you may be entitled to in the divorce. Further, it may not be for the best interest of both spouses if a profitable business is split up. There are many issues and pitfalls that arise when a business is involved in a divorce. You should consult with an attorney who understands both the divorce and the business issues.
That said, although the legal impact of the physical custody label is debatable, if you are the primary parent, it is still preferable to have sole physical custody than joint physical custody. Conversely, if you are not the primary parent, it is still preferable to have the joint physical custody label than not to have it. This is because of the uncertainty over how a future court, evaluator, parenting consultant, guardian ad litem or others might interpret that label.
If you own your home or other land, this property must also be divided fairly. The court may order the property sold so that each of you will have your share as soon as possible. The court might award one spouse the home and give the other spouse other property, such as retirement accounts, that equal the equity in the home. If the court believes that it would be better for the minor children to remain in the home, it may permit the children and the custodial parent to remain in the home until the children are 18 years old. Then the proceeds from the sale of the home will be split.
Many people think that when a couple wants to live apart they have to get a "legal separation." This is not true. Often couples live apart for awhile before they decide to get a divorce. This is not "illegal." Legal separations are for people who do not want a divorce (usually for religious reasons). They still need a legal paper to settle custody, support, and property questions. The court makes the same kinds of decisions that it makes in a divorce. However, the couple remains married, and the division of property is not final.
