Historically, courts would only grant a divorce if one spouse could prove the other's wrongdoing - for example, by presenting evidence of adultery, abuse or failure to support. Fortunately, those times are long past. Minnesota is now a no-fault state, which means you don't have to prove fault-based grounds to get a divorce. It's enough to assert that irreconcilable differences caused the marriage to break down.

In almost all cases, you will be required to attempt some form of alternative dispute resolution. This will typically take the form of "mediation" which is a process in which a neutral third party, typically an attorney trained in mediation, will attempt to assist the parties in reaching their own compromise settlement of some or all issues between the parties. The mediator does not make decisions, but rather facilitates a discussion between the parties (sometimes alone and sometimes with the assistance of counsel) aimed at reaching settlement of your issues. The mediation process is confidential, and if you are not successful in reaching a mediated settlement, the judicial officer will never learn what positions either party took in mediation. As part of the mediation process, the mediator will request both parties provide an accurate summary of income, assets and liabilities. It is recognized that sometimes, one party controls some or all of this information, and skilled mediators attempt to assure that there is a full and fair disclosure of financial information, and a full and fair discussion of the issues.
These court actions add delays, thousands or tens of thousands of dollars of costs, and interpersonal stress to the process of reaching a separation agreement. As the chart illustrates, the only way to guarantee an uncontested divorce, with no expensive, antagonistic, and time-consuming court actions, is through divorce mediation, a collaborative law divorce process, or out-of-court divorce negotiations. If alternative dispute resolution is not able or available to resolve temporary issues, many counties will allow formal hearings to decide temporary issues, including who will have temporary possession of the homestead during the proceeding, who will pay the mortgage, taxes, insurance and utilities on the homestead, what type of temporary custody/parenting arrangement is in the children's best interest, what amount of temporary “child support” is appropriate, what amount of temporary “spousal maintenance”, if any, is appropriate, who should pay other debt on a temporary basis, and whether there should be an award of temporary attorney fees. These requests are traditionally based upon written “motions” which is a written request for relief, with the “testimony” reflecting your position being summarized in a sworn, written affidavit. Sometimes you will also submit affidavits from other people in support of your position. The attorneys will then argue your position before a judge, who thereafter will issue a written order deciding the temporary issues.

The court may restrict parenting time if the parent seeking parenting time may harm or kidnap the children. The court can do this by limiting the hours of parenting time or limiting the place where parenting time can take place. The court can require that he or she only visit when another person is present (supervised parenting time). In very rare cases, parenting time may be denied altogether.
It is important to understand that each case is unique; however, a number of key factors influence the length (and cost) of your process. The first factor is preparation. Completing the requested preparations in advance and supplying the necessary documentation allows us to move more quickly. The second factor is complexity. Certain situations are simply more complicated to work through than others. That said, even the most complicated cases can be settled through mediation. During your free consultation, I am typically able to identify potentially complicating factors. Third is emotional readiness and conflict. Often times divorcing spouses are in a different stage of readiness; these differences can lead to conflict which may lengthen the time needed to resolve the issues. When you both feel ready to move forward and you are able to discuss the issues without a lot of conflict the process tends to move more quickly. The attorney representing either the petitioner or the respondent can schedule a temporary relief hearing. The other party must be served with motion papers, including a Motion for Temporary Relief and an Affidavit. Affidavits are written statements signed under oath. The motion papers are legal papers requesting temporary relief from the court and stating the facts on which the request is based. These facts include the income and expenses of each party, who has the children now and why they should be in the custody of the party asking for temporary custody. The motion papers must be mailed or handed to the other party before the hearing. There are certain time periods for giving notice to the other party before the hearing that must be followed when bringing and responding to motions. The petitioner's attorney often has the motion papers served at the same time as the Summons and Petition.
Although each mediator has his or her own approach, most mediations tend to move along the same lines. You'll usually start with a phone call in which you'll speak with the mediator or an assistant and provide background information about your marriage, your family, and what the issues are. Some mediators want a great deal of basic information before the mediation begins, while others prefer to gather all of the information in the first meeting when everyone is present.
Once the decision to mediate is made, it is necessary to find a mediator. Many counties have community-based or court-annexed mediation centers. If the mediation is court-ordered, the court may appoint a mediator, or will allow the parties to agree upon a qualified mediator. Both lawyers and non-lawyers serve as mediators. The fees charged vary from mediator to mediator and from case to case.
Like legal custody, physical custody can be “sole”  or “joint”. “Joint physical custody” means that "the routine daily care and control and the residence of the child is structured between the parties."  Unlike joint legal custody, joint physical custody is the exception rather than the norm, and is usually only granted if both parties agree to it.
NOTE: There are many ways to divide real estate in a divorce. The court forms for marriage dissolution (divorce) only give you 1 option -- one spouse gets 100% of the house, cabin, or other real estate, and the other spouse gets a lien. But, you can change the court forms. An attorney can explain other options, advise you about the law, and draft terms to meet your situation.
