You can ask the court for an Order for Protection. It will order the abuser to stop all the abuse and threats. It can also order the abuser to leave the home, to stay away from your work place or school. It can provide for temporary custody, child support and use of the car or home. It can also do other things to protect you and the children. It doesn't matter whether or not you've started a divorce or if you're still living together.
You may be surprised to know that most MN divorce cases (over 90%) are settled before they ever reach a court room. Mediation is so effective that the State of Minnesota requires you make a good faith effort to settle your divorce through Alternative Dispute Resolution (ADR) before appearing in Court – so why not start with a process which is proven to work as well, if not better, than litigation?
The belief that the mediator will act as a quasi-judge and tell the people what they are going to do is another very common misunderstanding that I hear about the divorce mediation process. In actual fact, one of the greatest advantages of the mediation process is that the parties themselves retain control over all decisions made and agreements reached. This is very different from the litigation model where a judge, essentially a stranger in a black robe, imposes orders and judgments on the parties.

Minnesota law allows a parent, legal, guardian, teacher, or other caretaker of a child or student to use "reasonable force" to "restrain or correct the child."  That said, in the context of a pending divorce or child custody case, it is inadvisable to use any kind of corporal punishment at all. Many of the guardian ad litems, custody evaluators, psychologists, and others involved in the family court system have strong feelings against the use of any kind of corporal punishment or physical correction of a child at all; and a parent's use of corporal punishment might become a reason why one of these professionals makes custody, parenting time, or other recommendations that are contrary to your wishes. Also, the use of any physical force at all can be exaggerated by the other parent, who may do so in order to gain an advantage in a custody and parenting time contest, even to the point of bringing a petition for an order for protection against you on behalf of the child. It is far safer, therefore, to use alternative disciplinary techniques, such as time-outs, verbal reprimands, withholding of privileges, etc.
Like legal custody, physical custody can be “sole”  or “joint”. “Joint physical custody” means that "the routine daily care and control and the residence of the child is structured between the parties."  Unlike joint legal custody, joint physical custody is the exception rather than the norm, and is usually only granted if both parties agree to it.
Just because an asset is titled in one spouse’s name does not mean that asset belongs exclusively to the title-holding spouse. How you acquired the property determines whether property is marital or nonmarital, which determines how (or whether) the property will be divided. Marital property includes assets purchased or paid for during a marriage. Marital property will usually be divided between spouses. Non-marital property is different, however. Nonmarital property includes assets that are acquired by only one spouse, either as a gift or inheritance, as property the individual brought into the marriage, or in some instances, that one party acquired alone during the marriage. An attorney can help you figure out what property is marital and what is not. An attorney can also advise you about how to protect your assets in a divorce.
If the parties are hostile or overly emotional, the mediator will separate the parties and shuttle back and forth between them in "private caucuses." A private caucus is a conference between the mediator and one party, without the other party being present. The mediator passes offers and demands between the parties. Conversations between a party and the mediator during private caucus are confidential unless a party authorizes the mediator to disclose information to the other side.
In order to make informed decisions as to division of marital property, and appropriate amounts of child support and spousal maintenance, it is necessary for each party to be fully informed of identity of each parties' income and assets. This information is typically exchanged through a process known as discovery. This is a process in which the lawyers may utilize numerous techniques for obtaining the financial information necessary to fairly identify and value all income and assets. The lawyers may informally by letter request the information they feel is necessary to identify all marital income and assets, or, in some cases may feel the need to serve "Interrogatories" and "Requests for Production of Documents” which are formal questions and requests for financial information and documents, such as tax returns, bank statements, financial statements and other information, which must be answered and sworn to under oath, within thirty days. In today's practice, some court's control what discovery they will allow, and may not immediately allow for the service of formal discovery, preferring the parties first use informal discovery. The attorneys may also notice the depositions of the parties themselves, or other people who may have relevant information, such as bankers and business associates. At a deposition the witness is sworn under oath, and the attorneys ask questions of the witnesses, which testimony is preserved in writing by a court reporter. The attorneys may also employ experts, such as "vocational evaluators," in the event it is alleged that a spouse who has not been working or who has only been working part time, is able to earn income to contribute to their support. They may also employ accountants or other business valuation experts to appraise family-owned or closely-held businesses. They may also employ other experts to appraise other assets such as real property and personal property, such as furnishings, jewelry and artwork.
Mediation also allows couples to avoid the risks of trial, protects confidentiality, and decreases stressful conflict. Mediation may also protect the children of a marriage from the pain of parental conflict. Because the parties work to create their own agreements, couples who mediate their divorce settlement often find greater satisfaction than those who go to trial. Moreover, the couples learn skills to help them resolve future conflicts.
Essentially, a Social Early Neutral Evaluation is similar to mediation in that it is a form of alternative dispute resolution that is voluntary and non-binding. The difference is that with ordinary mediation, the mediator generally will not take a position. Whereas the evaluators presiding over an SENE are specifically tasked to give their recommendations, as a way to help the parties reach a settlement.
Many of those who have successfully gone through divorce mediation note it is a much less expensive alternative to litigation. The costs of litigation are generally an unknown until the case settles. At that time the spouses may be shocked at the level of fees they have incurred through attorney’s fees, expert witnesses, depositions, preparation of the case for trial, filing motions back and forth and many other things associated with divorce litigation. Mediation, on the other hand, allows couples to have a good estimate of the number of hours it will take to resolve the issues at hand. The ultimate goal of mediation is to resolve the issues quickly, and this translates to financial savings.
Another helpful approach for very high-conflict cases can include bringing an additional professional into the mix, such as a marriage and family therapist, who can meet with one or both parties in the mediation session or separately, as appropriate. The goal of the therapist is not to reconcile the parties, but to help them develop a better ability to communicate around the emotional roadblocks that they are facing. In the end, by going through the mediation process together and reaching reasonable solutions to the issues facing them, parties that mediate learn new ways of working together as they go forward into their new future. This is a huge benefit, especially when children and co-parenting are involved.
In a very limited number of divorce mediations, one spouse feels the mediator favors the other spouse. In such a case resolution is unlikely to occur. If a spouse is concealing issues during mediation, the mediator cannot compel him or her to reveal such things as accurate assets or income. In contrast, an attorney can depose the spouse, require financial information or even counsel the client to hire a forensic accountant. Divorce mediators don’t have the authority a judge has, meaning the success of the mediation is wholly dependent on the cooperation between the parties.
You'll then attend the first meeting—usually held in a conference room or comfortable office—where the mediator will explain what you can expect from the process. For example, the mediator may tell you that everyone will be in the same room for the entire mediation or that you'll meet in separate sessions so that the mediator can get your views or positions in private. The mediator may also take care of some housekeeping business—for example, ask you to sign an agreement that says that you'll keep what's said in the mediation confidential and that you understand that the mediator can't disclose any of what goes on there if there's a court proceeding later on. At the same time, the mediator will try to make you feel comfortable by establishing a rapport with both you and your spouse.
There is no right to a free lawyer (like a public defender) in a divorce. However, there are nonprofit law firms that provide free legal help or arrange for volunteer attorneys for low income clients. See the back of this booklet for information on legal services. If free legal help is not available, or you do not qualify, you will need to hire an attorney or represent yourself in the divorce.
In some cases, a spouse may be reluctant to attend mediation due to misperceptions they have regarding the mediation process. One party may feel the mediator will decide crucial issues without input. In reality, a divorce mediator cannot compel either spouse to do—or refrain from doing—anything. Others may feel a mediator can single-handedly “fix” all issues in the divorce. If one spouse fails to disclose all relevant facts related to the case, the mediator will be unable to achieve real results. In some cases, women may feel their husband will fare better during the mediation.
States regulate the manner in which marriages may be dissolved (i.e. divorce), just as they regulate the marriage process itself. These regulations often include residency requirements, waiting periods, acceptable grounds for divorce, and defenses to divorce filings. Like many family laws, the legal requirements for divorce have changed drastically over the course of history to reflect the times. For instance, a spouse who wanted a divorce had to first prove the other party's fault (such as adultery or desertion) before the advent of "no-fault" divorce.
It can be difficult for a client to know whether his or her lawyer is performing well or not. Sometimes even the best of lawyers does not achieve the desired result, and it may be due to a difficult set of facts, a bad judge and/or custody evaluator or guardian ad litem, or unrealistic expectations. There are some clear indications of bad lawyering, however, which are objectively obvious:
Although each mediator has his or her own approach, most mediations tend to move along the same lines. You'll usually start with a phone call in which you'll speak with the mediator or an assistant and provide background information about your marriage, your family, and what the issues are. Some mediators want a great deal of basic information before the mediation begins, while others prefer to gather all of the information in the first meeting when everyone is present.
Some spouses are under the impression that they must obtain a legal separation to get divorced. To the contrary, legal separation is an alternative to divorce, but the process is almost identical: you file legal paperwork, deal with all the same issues in a divorce, and ask a judge for an order of legal separation. If you plan to divorce, a legal separation is unnecessary and will only increase the total cost of the divorce.
It is important to remember that the child support obligation terminates automatically at this time.  The obligor doesn’t need to return to Court to stop it. He just needs to stop paying. That said, if payment is through automatic income withholding, it is a good idea to alert your child support case worker in advance of the termination date, to be sure they don’t overlook it and continue withholding the money from your paycheck.

Mediation is an option that allows divorcing couples to maintain control over their decisions at a lower cost. Mediation is also an effective choice for never-married couples and for those experiencing post-decree conflicts.
Basic support is for the child's expenses, such as food, clothing and transportation, and does not include payments on arrears. It is calculated by multiplying the paying parent's percentage of the combined Parental Income for Determining Child Support (PICS) by the combined basic support amount. If a court orders parenting time to the paying parent of ten percent or more, he/she may receive a deduction from basic support, based on the percentage of court-ordered parenting time.
When discussing issues concerning custody parental access, think about where your kids will spend most of their time: where they go to school, where they take dance and karate and other extra-curricular activities. Think about whether they have any special needs and how you’ll care for them, how you’ll cover any private school or college costs, and where they’ll spend birthdays, holidays, and special occasions.
Seeing headlines like these, who doesn't think that hiring a $1,000-an-hour divorce attorney is the best way to get what you deserve? But in reality, divorce isn't a winner-take-all sport. In community property states (like California) courts have to split marital property down the middle. In states that don't have community property laws (like New York) they split assets equitably.
To get a no-fault dissolution in Minnesota, you need to state in the Petition for Dissolution of Marriage that “there has been an irretrievable breakdown in the marriage relationship.” Also, one of the following must exist: (1) serious marital discord adversely affecting the attitude of one or both of the parties toward the marriage, or (2) the parties have been living separate and apart for 180 days before filing.
The best mediators have both a high level of experience and knowledge about divorce and family law and a calm and diplomatic approach to the situation and towards each of the parties. Mediators who have spent many years as attorneys, representing clients in mediations and litigations, have had the opportunity to see many situations and many types of resolutions. As mediators, they are often able to help clients think outside the box and craft creative solutions. They can also offer perspective on how similar cases have been perceived by the courts. But the mediators approach in presenting this information is also critical. Mediators need to be able to rise above the emotion and conflict that is often present, and help the parties see what is and isn’t relevant to resolving their case.

In Minnesota, alimony or spousal maintenance is available as temporary, short-term or long-term. Temporary alimony includes payments made during the course of the divorce proceedings, while short-term involves a limited period following the divorce. Long-term spousal maintenance is essentially permanent. In most cases, alimony is short-term and allows the dependent spouse to obtain skills to sustain themselves. The court will consider the following when awarding alimony:
To file for divorce in any state you need to meet its residency requirements. These requirements vary by state. Two additional things that you should consider when thinking about relocating are what the divorce laws are where you are compared to the laws of the state that you are moving to, and what is the impact on any children involved. To the first point, you want to make sure that you aren’t filing for divorce in a state where the divorce laws are less favorable to you. To the second point, courts can and do frown on one parent’s leaving the state without the other’s consent. A lawyer can help you figure out which state would be best to file in and how to negotiate and interstate custody issues.
I use only processes—mediation, collaborative law divorce, and out-of-court negotiation—that emphasize open, respectful communication. I am currently not taking "contested" cases, in which each spouse hires a lawyer and fights in court. If you have been served with divorce papers or need legal representation in court, you should contact a different attorney.
During a divorce, either party can petition the court to pay alimony or “spousal maintenance” to the other. Minnesota laws provide for this type of assistance so the lower earning spouses can maintain the same reasonable standard of living as before. Generally speaking, a court will be more inclined to order a longer period of alimony when the marriage was longer in duration.
All divorce mediators will work hard to put everyone at ease, allowing the process to proceed in an informal, comfortable atmosphere. Most divorce mediations last from two to five sessions. While these sessions are structured to address specific issues in a specific order, one party or the other may need to gather additional information or consult with their attorney. In this case the specific issue may be skipped, and readdressed later. If both spouses agree, other professionals such as child psychologist, accountants or attorneys may be allowed to attend the mediation in order to clarify specific issues. If both parties agree, a relative or trusted friend may attend mediation, however their participation in the process is extremely limited. Children may be present during later sessions if the parents agree, but rarely during the first session.
Although many mediating couples are amicable and work well in mediation, there are also many couples who are very emotional about the divorce and don't think they can negotiate face to face. Part of every qualified mediator's training is in assisting couples who have high emotions but who still would like to work things out peacefully. People do calm down and become effective mediation participants when they see that the process can work without adding to the high emotional and financial cost of divorce.
All people have power in different ways. It is my job as mediator to balance power and ensure that both clients have an equal voice and ability to impact outcomes. In mediation, power comes from knowledge and information. Documented information about assets and liabilities and a broad understanding of each other’s needs are what make you successful in mediation.
After discovery is completed, the attorneys will typically work with you to formulate a settlement proposal which is presented to the other side, either as part of a settlement meeting at one of the attorney's offices, or simply through a letter sent to the other lawyer. The attorneys will prepare a balance sheet summarizing your assets and liabilities. In Minnesota, the law requires an "Equitable Division of Property," which typically, but not always indicates an equal division of property. Parenting time proposals may also suggest the future use of a "Visitation Expeditor" or "Parenting Consultant" who are neutral third parties retained to assist in resolving future parenting and parenting time disputes. When the parties have children, settlement discussions will also involve "child support", which is currently set pursuant to "child support guidelines" based on a comparison of the gross incomes of both parties, and the amount of time the children will spend with each party. If one of the parties lacks the resources to support themselves, settlement discussions will also involve requests for either temporary or permanent "spousal maintenance." Pursuant to Minnesota Law, spousal maintenance while based on a consideration of several factors, ultimately will be based upon a consideration of the marital standard of living, the needs of the spouse requesting maintenance and the ability of that spouse to meet those needs as compared to the needs of the spouse from whom maintenance is sought, and their ability to meet their own needs and still contribute to the support of the requesting spouse. Maintenance may be temporary or permanent, depending on the facts of the case, including length of marriage whether there is any uncertainty as to if the spouse requesting maintenance will ever be able to become fully self supporting.
Spousal maintenance is money paid to support an ex-spouse. Either spouse can ask for spousal maintenance, but the court will not award spousal maintenance unless there is a need for it. Spousal maintenance may be granted for several reasons. These include disability or illness or not having worked outside the home for a number of years. If there is a large difference between your income and that of your spouse, you may be in need of spousal maintenance.
