Although the advantages of mediation generally far outweigh the disadvantages, there are a few potential disadvantages associated with divorce mediation. A divorce mediator may not advise you on the legal aspects regarding the decisions you are making. This could result in an agreement which leads to a loss of important rights. This is why all mediated agreements should be looked at by an experienced divorce attorney prior to giving it to the judge for approval.
This is based on the outdated belief that women know less about the marital finances than their husbands, therefore will not be left with a favorable outcome in the divorce. It is important to remember divorce mediators are neutral and have no interest in either spouse “winning.” Finally, most people believe couples who are barely speaking could not possibly benefit from divorce mediation. Divorce mediators are highly trained in alternative dispute resolution and are skilled at working with those who have significant levels of anger between them. Obviously, both parties will be required to speak at some point, but the divorce mediator may be able to help that happen.
Mediation is confidential and non-binding. Mediators cannot force the parties into a settlement. Rather, mediators keep everyone focused and facilitate the exchange of information. Mediation is not appropriate in all cases, particularly those in which there is a history of domestic abuse among the parties. The actions and concessions of a party during mediation cannot be used against them in court pursuant to the rules of evidence.

It is important to remember that the child support obligation terminates automatically at this time.  The obligor doesn’t need to return to Court to stop it. He just needs to stop paying. That said, if payment is through automatic income withholding, it is a good idea to alert your child support case worker in advance of the termination date, to be sure they don’t overlook it and continue withholding the money from your paycheck.
Clients often ask whether they should move out of the marital home prior to or during the commencement of divorce proceedings. The answer is very clear: “it depends”. Generally speaking, if child custody, parenting time, or possession of the home might be an issue in the proceedings, I advise against it. Although many mediating couples are amicable and work well in mediation, there are also many couples who are very emotional about the divorce and don't think they can negotiate face to face. Part of every qualified mediator's training is in assisting couples who have high emotions but who still would like to work things out peacefully. People do calm down and become effective mediation participants when they see that the process can work without adding to the high emotional and financial cost of divorce.
In cases where you and your spouse cannot come to an agreement on major issues, the judge will schedule a bench or jury trial that will require you and your spouse to present arguments supporting your respective positions. In the vast majority of trials, it is the attorneys with trial experience that do most of the arguing and presenting of evidence. In addition to the legal fees paid to the attorneys, there are usually many court costs involved in a trial and pre-trial proceedings.

When a couple has made the decision to enter into divorce mediation, there are preparations which can be made which will ensure the mediation is more beneficial to both parties. Having an experienced divorce attorney in your corner is important before you attend mediation. Because a mediator is unable to give legal advice to either party, your legal questions can then be answered by your attorney. Before attending mediation, it is a good idea to make sure you are organized. This means having all documents pertaining to the issues you will be discussed together in a cohesive manner and bringing those documents to mediation.
In reality, every divorce requires both formal legal procedures as well as some kind of settlement negotiations. In Minnesota, even if you prefer to litigate and leave every decision up to the judge, the rules require that before the Court will decide your case, parties must attempt resolution through some form of Alternative Dispute Resolution, of which mediation is still the most common. 
If you are proceeding without an attorney, you are well-served to use an experienced mediator with extensive legal background able to address all of the issues surrounding your specific case; if you have a land dispute, you want to have a mediator capable of understanding your concerns and the law as well. If you have a divorce or custody case, you want a mediator with extensive experience litigating these issues.
File a notarized “Separation Agreement” signed by both parties. This is a written contract between spouses that addresses all issues related to:Property division (How are property and debts to be divided? Will one of you keep the house or will you sell the house? How will your retirement accounts be divided? What happens with credit card and student loan debts?)
This shortsighted approach overlooks many things, the first of which is the obvious waste of money. It’s important to ask yourself if the asset is really worth the fight. Divorce leaves most people with fewer assets than they had during marriage – why spend what you have left on attorney’s fees? It also overlooks the possibility that with more property on hand, the other spouse will be able to contribute to college costs and other child-related expenses. Finally, property allocated to your spouse may also reduce the need for alimony.
Civil lawsuits- those involving land, inheritance, or services provided, are most often moved to the end of any Court’s calendar. Often, a civil matter will not be heard before a judge for more than two years after the case is filed with the Court. This long delay for justice/resolution, together with the high costs of trial, often make litigation impractical. It is not uncommon for attorney fees, expert witness fees, filing fees, court reporter fees and other related costs to exceed the amount in dispute.

If you do move out, take steps to guard against destruction of property. Videotape the contents of the home (e.g., furniture, art and other valuables) and make copies of important documents (birth certificates, account statements, deeds and insurance policies) before you leave. You may also consider taking your own family heirlooms and other personal, irreplaceable items with you.

The Summons is a separate legal paper telling the respondent to answer the Petition within 30 days. If the respondent does not, he or she is in default and the divorce is uncontested. This means the petitioner (the spouse who wanted the divorce) may be granted the divorce and other relief requested. The Summons also forbids both parties from selling or getting rid of any property or harassing one another. It requires each party to maintain any insurance for the family. If one spouse spends money belonging to both parties after receiving the Summons, he or she will have to explain to the court why the money was spent.
You'll then attend the first meeting—usually held in a conference room or comfortable office—where the mediator will explain what you can expect from the process. For example, the mediator may tell you that everyone will be in the same room for the entire mediation or that you'll meet in separate sessions so that the mediator can get your views or positions in private. The mediator may also take care of some housekeeping business—for example, ask you to sign an agreement that says that you'll keep what's said in the mediation confidential and that you understand that the mediator can't disclose any of what goes on there if there's a court proceeding later on. At the same time, the mediator will try to make you feel comfortable by establishing a rapport with both you and your spouse.

Minnesota law allows a parent, legal, guardian, teacher, or other caretaker of a child or student to use "reasonable force" to "restrain or correct the child."  That said, in the context of a pending divorce or child custody case, it is inadvisable to use any kind of corporal punishment at all. Many of the guardian ad litems, custody evaluators, psychologists, and others involved in the family court system have strong feelings against the use of any kind of corporal punishment or physical correction of a child at all; and a parent's use of corporal punishment might become a reason why one of these professionals makes custody, parenting time, or other recommendations that are contrary to your wishes. Also, the use of any physical force at all can be exaggerated by the other parent, who may do so in order to gain an advantage in a custody and parenting time contest, even to the point of bringing a petition for an order for protection against you on behalf of the child. It is far safer, therefore, to use alternative disciplinary techniques, such as time-outs, verbal reprimands, withholding of privileges, etc.
The guidelines use each parent's monthly gross income and consider basic, medical and child care support. A parent's monthly gross income is reduced by the amount of spousal maintenance or child support that the parent is ordered to pay from other support orders. Minnesota law allows a deduction from a parent's monthly gross income for a maximum of two non-joint children in their home.
It is understandable that when people reach agreements together based upon what they think is right and fair, their agreements are much more sustainable going forward than court orders that tell the parties what they must do or not do, pay or give to the other party. In fact, a great advantage of mediating your divorce settlement is that you will make all the decisions together about what is best for you both and for your children as you go forward.
Prior to the temporary relief hearing, as indicated above, both parents have custody. One the one hand, it is a disadvantage to agree to a parenting time schedule — even on an interim basis — which is less than what you want on a permanent basis, because even though this is not legally relevant, I have seen judges swayed by arguments about who has had the children prior to the court appearance. On the other hand, children shouldn’t have to witness their parents fighting at the day care center doors about who gets to take them home. Sometimes the best approach is just to share the time 50-50 for the sake of compromise, until the matter is heard by the Court. If for the sake of the children you feel it is best not to fight about it, it is very important to send written notice to your spouse explaining your strong objection to the interim arrangement, e.g.:
The law allows parents to make voluntary parenting plans. A parenting plan is a plan voluntarily designed by both parents based on the best interests of the child. A parenting plan must include a schedule of the time each parent spends with the child, who will make specific decisions regarding the child, and a way to settle disputes. An agreed-upon parenting plan may use terms other than “physical” and “legal” custody but it must clearly state if the parents have joint legal custody or joint physical custody or which parent has sole legal custody or sole physical custody.
