When a couple has made the decision to enter into divorce mediation, there are preparations which can be made which will ensure the mediation is more beneficial to both parties. Having an experienced divorce attorney in your corner is important before you attend mediation. Because a mediator is unable to give legal advice to either party, your legal questions can then be answered by your attorney. Before attending mediation, it is a good idea to make sure you are organized. This means having all documents pertaining to the issues you will be discussed together in a cohesive manner and bringing those documents to mediation.

On average, pre-decree divorce mediation can be completed in 4-10 sessions. Again, how long it takes really depends on what if any communication there is between the divorcing couples and their level of animosity for each other. If either one of the spouses is unwilling to budge from their certain position on a divorce issues, mediation may not be an option for them and they may have to litigate in court. Once this happens, communication is shut down and the fight begins.
You'll then attend the first meeting—usually held in a conference room or comfortable office—where the mediator will explain what you can expect from the process. For example, the mediator may tell you that everyone will be in the same room for the entire mediation or that you'll meet in separate sessions so that the mediator can get your views or positions in private. The mediator may also take care of some housekeeping business—for example, ask you to sign an agreement that says that you'll keep what's said in the mediation confidential and that you understand that the mediator can't disclose any of what goes on there if there's a court proceeding later on. At the same time, the mediator will try to make you feel comfortable by establishing a rapport with both you and your spouse.

At the end of the petition is a section referred to as a prayer for relief, where the petitioner will indicate in general their desire that the marriage be dissolved, as well as their desires as to custody/parenting time, child support, spousal maintenance, property and debt division, and allocation of attorney fees. In Minnesota, the court may order one party to pay part of the other's attorney fees, based on consideration of two factors, the first being need, and the second being whether one party's conduct has unnecessarily increased the attorney fees of the other party.

The big warning I have is this: years ago, when the program started, the idea was that the evaluators would give their opinion of how they would likely decide the case in a full-blown custody evaluation, based on the facts learned in the SENE. This honest appraisal of how a months-long custody evaluation would likely turn out is what helped parties to settle their cases.
Mediation also allows couples to avoid the risks of trial, protects confidentiality, and decreases stressful conflict. Mediation may also protect the children of a marriage from the pain of parental conflict. Because the parties work to create their own agreements, couples who mediate their divorce settlement often find greater satisfaction than those who go to trial. Moreover, the couples learn skills to help them resolve future conflicts.

A business which is the sole source of the couple’s income could end up shut down if the couple is unable to discuss the issues related to the business. This could lead to both parties suffering financially. A divorcing couple with a business can enter divorce mediation and may be able to come up with a compromise which could potentially save the business. Even if every little detail is not agreed upon, the mediator will attempt to get the couple to work together for the good of the business.
Grounds which the courts in the past have recognized as valid reasons to permit out-of-state relocation are: a better job opportunity in the other state; [4] and joining a fiancé who resides in another state. [5] These reasons do not guarantee that permission will be granted, but they have been recognized as legitimate grounds for seeking such permission.
A mediator’s job is to get you to reach an agreement. Their sense of professional fulfillment is satisfied when an agreement is reached. Unfortunately, all too often, this can result in a person agreeing to things that are contrary to his or her interests, contrary to what the Court would order, and — in the worst case — contrary to the best interests of the children. Therefore, it is critically important to either have an attorney with you at the mediation session, or at least have one on retainer at the time, to consult before you agree to anything.
The mediator will also ask you and your spouse to bring in financial documents such as tax returns and bank and mortgage statements. As you progress, the mediator will summarize the information being assembled. If you agree that additional research is needed or a neutral expert is to be consulted, that will go on a “to do” list. This second stage of the mediation can span two or more sessions, especially if you need to do outside work to obtain additional information or appraisals. If you feel that you already know enough about your situation and have definite ideas on how to work out a settlement, you may find yourself impatient with this stage and anxious to move ahead with the negotiations. Even though you may want to rush on, the mediator’s job is to make sure that both you and your spouse have all the facts and information you need to negotiate an agreement that is legally binding and that you won’t regret having signed.
Notwithstanding all of the above, mediation can often be the process that helps break an impasse and result in a reasonable settlement of one’s case. But for mediation to work, both parties must be prepared to compromise. If you approach mediation with the attitude that it will be an opportunity to convince the other party to do things your way, mediation will likely fail. That said, be careful not to concede too much. A lawyer can give you an appreciation for where the line is between generous cooperation and foolish capitulation.

Depending on the judicial officer, most ICMC's are fairly informal. The judicial officer will come into the courtroom, and give a small presentation to the parties. Literally all presentations are based on a common theme - the benefit of working cooperatively to reach a mediated settlement. The judicial officer will discuss the high cost, both financially and emotionally, of litigating your divorce issues rather than working towards an amicable settlement. The judicial officer will then discuss with the lawyers what issues they believe your case presents, what needs to be done to reach a resolution of those issues, what procedures the lawyers believe are necessary to prepare the matter for resolution (either through subsequent settlement or trial) and how much time will be needed to complete this work. At this point, it will be determined whether a temporary hearing is necessary to determine issues involving possession of the home, parenting of children, temporary child support and spousal maintenance, as well as temporary attorney fees, while the divorce proceeding is pending. Many times the courts will encourage the parties to participate in an early mediation sessions to determine temporary issues. On rare occasions in today's family law practice, a formal temporary hearing may be needed, as described below. In lieu of such a hearing, some judicial officers may request the lawyers follow a more informal process of simply writing the judicial officer a letter providing the economic data necessary to decide temporary issues together with brief argument. The judicial officer will then decide the temporary issue.
1st meeting: The couple and the mediator identify the issues needed to be discussed and the order in which they will be discussed, then decide what information needs to be gathered and shared. Between the first and later sessions the couple gathers all relevant financial data, or if necessary, the opinions of experts such as appraisers or accountants, with this material treated with the same care and concern as would be the case in the adversarial process.

(Minnesota Statutes - Chapters: 518.619)
Mediation is also confidential. Nothing said in mediation may be used against a person. Many times people tell me they agreed to something in mediation because they were afraid they might be seen as unreasonable. This should not be a concern in mediation, because of the confidentiality rule. (Outside of mediation, your lawyer can advise you as to what positions are reasonable or unreasonable).

Divorce is actually a legal procedure between you and your spouse, so, in order to satisfy legal requirements, you must properly notify your spouse that legal action is being taken against them. In a divorce proceeding, this is called Service of Process, and involves delivering copies of the Petition for Dissolution of Marriage and Summons along with supporting documents to your spouse in a timely manner.

Resolutions emerge from the mediation that are created and accepted by BOTH parties. The resolution will reflect each party's individual values and unique needs. Our experience has shown that settlements created with full participation of the parties, in face-to-face negotiations, are more likely to satisfy the needs of all parties and be honored in the future because they have crafted it themselves.

Sign and file a “Joint Petition for Divorce.” (Divorce court officials sometimes refer to this as the “1A form” and this divorces process as a “1A Marriage Dissolution.”) This is a divorce form that a) states when you were married and last lived together, b) identifies minor or dependent children of the marriage, c) identifies any family law court actions already in process, d) suggests an approximate date when the marriage irretrievably broke down (when it effectively ended), e) requests a divorce, and f) asks the judge to approve your “Separation Agreement” (see below).

If there are children of the marriage, each spouse has the right to decide where the children live or go to school, whether they should see a doctor, and can make other arrangements that need to be made.  These decisions are left to the parents, as long as the children are not being hurt.  If the children are being hurt, other people might become involved —doctors or nurses, school personnel, community workers or the police.  If you do not want your spouse to take or visit the children because you are afraid the children will not be returned or will be harmed, you do not have to let the children go.  However, if there is not a threat that your spouse will kidnap the children, you should think about the children's best interests and whether it would be good for them to see their other parent.  If you are concerned about your spouse's visits, consider getting a custody order.  If there are children who were born before the marriage and there has been no adoption or custody order, the mother has sole custody in Minnesota until there is a court order to the contrary.
